Hill, Clarence E. v. Crosby, Sec., FL DOC, et al. (05A676)

The application for stay of execution of sentence of death presented to Justice Kennedy and by him referred to the Court is granted. The motion of petitioner for leave to proceed in forma pauperis and the petition for a writ of certiorari are granted. The brief of petitioner is to be filed with the Clerk and served upon opposing counsel on or before 3 p.m., Monday, March 6, 2006. The brief of respondents is to be filed with the Clerk and served upon opposing counsel on or before 3 p.m., Monday, April 3, 2006. The reply brief, if any, is to be filed with the Clerk and served upon opposing counsel on or before 3 p.m., Monday, April 17, 2006. The stay shall terminate upon the sending down of the judgment of this Court.

1. Hill's execution of death has been stayed (stopped temporarily). (Hill is the petitioner.)

2. Hill's request to waive SCOTUS costs was allowed because Hill is indigent (poor).

3. Hill's request for SCOTUS review of his case is granted.

4. Hill must file (w/ the SCOTUS clerk) and serve upon Crosby (who is the Secretary of the Florida Department of Corrections) Hill's initial SCOTUS review paperwork (brief of petitioner on the merits of the case) on or before 3 PM EST Monday March 6, 2006. (Crosby, in his official capacity as Secretary of the Florida Department of Corrections, is the respondent.)

5. Crosby, Secretary of the Florida Department of Corrections (respondent), must file (w/ the SCOTUS clerk) Crosby's initial SCOTUS review paperwork (brief of respondents) and serve upon Hill's attorney on or before 3 PM EST Monday April 3 2006.

6. Hill may file (if Hills wants to do so) another SCOTUS review paperwork in response (a reply brief) to Crosby's brief of respondent; however, such reply brief must be filed (w/ the SCOTUS clerk) and served upon Crosby's attorney on or before 3 PM EST Monday April 17, 2006.

7. The stopping (stay order) of Hill execution of death terminates immediately upon SCOTUS opinion (judgment) in this case. (Which would be anytime prior to mid-to-end-of-June 2006 when this October 2005 term of SCOTUS ends; most likely in a stay of execution of death case, it will be sooner rather than later in the term but that's only a guess. In SCOTUS's opinion/judgment it may or it may not over-turn Hill's execution of death.)
