Gay panic defense! I'm watching the Biography Channel. It is about the t
trial of the boy that killed Matthew Shepherd. They used the "Gay Panic Defense." I've never heard anything so stupid. They said Matthew made a pass at the guy and the guy panicked and killed him.

Twenty six blows to the head. That is not panic. That is hate. Sickening!

1. How about a "straight panic defense"?
If some half-drunk lothario starts hitting on a woman in a bar, she should be entitled to blow him away with a 12-gauge because she feared his advances.

Personally, I'd like a "fundie panic defense" so I could get a "get out of jail free" card if I loose control the next time one of them shoves one of their pamphlets in my face as askes, "Do you know Jebbus as your personal lord and sav- ..." BANG!

3. aka "The Twinkie Defense"
Dan White murdered Mayor George Moscone and openly gay City Supervisor Harvey Milk of San Francisco in 1978. It was argued that White was depressed at the time of the shooting. According to expert witness, White's depression may have been exacerbated by White's excessive consumption of Twinkies and Coca-Cola. He was judged incapable of premeditation and convicted of voluntary manslaughter.

Gay Panic Defense & The Twinkie Defense are the same thing.

The twinkie defense was an attempt a pseudo-science. The gay panic defense is a way to capitalize on homophobia and the fears of straight men that any gay man who see them will fall instantly in lust and won't take 'no' for an answer until the objects of their affection have submitted to the lustful ways of the homo-seck-shuls and been recruited into that "gay lifestyle" thing we hear about.

Henderson and McKinney drove him out to that remote area where they killed him. That took intent and planning. A crime of passion/panic would mean that they reacted and killed him right on the spot where he "made a pass". The "gay panic" defense is nothing but BS.

She's a Canadian lawyer. The 'homosexual advance' defense...can't remember, but I remember he saying it's actually a law on the bookd.

7. First you demean them
with names that mean they are somehow less "manly" than you are then you run scared (kill them so they won't do that again) when they look at you. Sure, makes sense to me. :sarcasm:

8. It's been used successfully for years.
I remember a case back when I lived in Lincoln, NE. Some guys beat a gay man to death with a tire iron. They said he'd made advances to them. They got off with probation I believe. 'Course the gay guy got off with dead. Guess they thought that was fair.
