Ohio Law Compels Person to Disclose Vote if Allegations of Fraud
District Challenges Vote Count

The London City School District has filed a court petition contesting the results of a school levy that lost by one vote.

Elections officials have counted the votes at least four times.

The petition filed yesterday in Madison County Common Pleas Court asks a judge to force a couple who voted twice to say how they voted on the issue. And, if they voted no, it asks the court to throw out the votes and declare the school issue passed by one vote.

Prosecutor Stephen Pronai says Wilbur and Rebecca France have admitted voting by absentee ballot, then at the polls on Election Day.

The school district's lawyer says Ohio law lets authorities compel a person to disclose how they voted when there is an allegation of fraud. Pronai says the grand jury will review the case next month and decide whether to charge the couple.

1. 1) It sounds like it only applies where you can build a case that an
individual voted fraudulently. 2) What are you going to do, subpoena everyone who voted in a county to appear before a grand jury?

If this does apply (and I can't see why it wouldn't) to state wide elections, it might be useful if you can make very specific allegations.

Of course, if you have people that are willing to commit fraud by voting twice, there's nothing to stop them from lying about which way they voted.
