The Lever to Move Byrd
There is one thing Senator Byrd cares about more than any other issue. He's publicly hung his hat on it, and made his stand there.

Defense of the U.S. Constitution

If Byrd votes to confirm Alito, he's not just letting West Virginians down, he's letting down the Constitution. He's trashing the very document he stood up to defend so eloquently many times in the last five years.

He MIGHT change his mind if he can be convinced that Alito WILL trash the Constitution, subject the Judiciary to the power of the "Unitary Executive," and piss all over the Separation of Powers that the Founders wisely tried to guarantee.

Try that.

...that all of his eloquent speechifying on the subject of the Constitution has been mere self-aggrandizement.

But is an election year a good time to make something like that obvious?

Senator Byrd a hypocrite? Senator Byrd abandoning the Constitution?

Please, Senator, show me it ain't so!

4. We have a few days to work on Mr. Byrd...be nice when you call!
I want to believe in Senator Byrd, because I have all my adult life. I've voted for the man every time, since I became old enough to vote. I never thought I'd ever not want to vote for him. This is a very hard day for me!

6. Perhaps he would consider the possibility of abstaining on the cloture
vote. He does not have to vote FOR a filibuster... he can just abstain. The other side HAS to have 60 votes. Every abstention is a vote that they do not get!

He's sucked up 88-THOUSAND dollars of MoveOnPac's money. He's taken money from progressives and liberals, most of whom didn't have it to give in the first place.

He's already caved on this. I doubt if a threat of the nookyulur option would even move him, now that he has a well-financed opponent in November (John Raese). He thinks this is how he locks up the religion industry vote in this state.
