Man charged with stealing after allegedly reneging on Hannah Montana tickets


Clay County authorities today accused a man of duping a Gladstone woman out of $560 by reneging on an agreement to sell her four Hannah Montana concert tickets.

Bryan K. Phelps Jr., 29, of St. Charles was charged with one count of stealing by deceit. Phelps was not in custody today but his bond was set at $10,000.

According to court records, the 40-year-old woman alerted authorities after she did not receive four tickets to the Dec. 3 Hannah Montana concert at the Sprint Arena. The woman told officials that she searched the eBay Web site in October for tickets. She said she found four tickets that were being sold by Phelps, court records said.

The woman said she called Phelps who agreed to end the eBay auction and sell the tickets to her through his PayPal account for $600, plus $10 to cover the shipping cost.

Phelps later sent the woman an email asking her to cancel the payment to his PayPal account because he forgot his password and PayPal had blocked his account, according the court records.

The woman then agreed to overnight a $560 money order to Phelps. Court records said Phelps signed for the package on Oct. 25. Phelps sent the woman an email the next day indicating that he received the payment and he would ship the tickets to her on Oct. 27, court records said.

The woman told authorities said she never received the tickets and Phelps told her the tickets must have gotten lost in the mail.

8. You're right.. this, to me, triggered the fraud alert
the moment the seller said his paypal account had been shut down.

I really like eBay (been doing it since its inception), and they are quite clear that buyers should never engage with sellers outside of the ebay. Although it doesn't make the situation right, the victim needs to be more careful. But I guess that alot of us (myself included - lost $800 once on an eBay purchase once) need to be burned before we really understand the risks.

10. Hell, she violated the E-Bay terms of service herself, it's a violation to ask a seller
to terminate an auction and do an end-run around the E-Bay fees, etc.

2. I must be out of the loop
as I have no idea who hannah montana is. I would never have spent that much on tickets and if I did the seller on ebay would have had to have a huge positive feedback profile.

3. Phelps, huh? Is that how they're paying their legal bills?
;)

I can't stand Hannah Montana. It's terrible music (they obviously alter her voice a lot), and it's everywhere for kids these days. My daughter loves her, and I'm trying to get her onto real music instead.
