Rape case ends after DNA test

"Had DNA never been done on the gun, would you have maintained that story that Brian Harden had sex with you ... and then assaulted you with the gun?" Lipinski asked the woman.

"Yes," the woman said, according to a transcript of the deposition.

"You would have said that at trial, too?" the defense attorney asked.

"Yes," she said.

"So you would have lied to the jury then?" Lipinski asked the alleged victim.

"Probably so," the woman replied.

"So when the gun was found and DNA was done, you felt trapped in a lie, correct?" Lipinski asked.

"Well, yes," the woman said.

2. Sometime in the very near future...
A commission to investigate how cases are brought and proper and improper use of evidence by prosecutors sure would be a nice touch.

Things have gotten out of control because prosecutors are counting coup to run for higher office and the crowds and media are screaming for blood for blood's sake and nothing more.

I'm sick of this bullshit. There need to be harsh penalties for phony or frivilous accusations of rape. It undermines people with real and legitimate claims.

13. there's a problem with that though
There are more cases where someone is accused of a crime, who the accuser truly feels is guilty (they may be mistaken, and they may be correct), but doesn't ever go to trial or the person gets off. In any one of these cases, someone could make the same case. It's up to prosecutors who they put on trial, not the accusers.

he obviously paid off her boyfriend/ his friend to shift guilt away from himself. I hope she managed to maintain custory of the children before this monster rapes his children as well.

I say that if you keep changing your story and, more importantly, the evidence doesn't back you up then you have to let it go. That's how our court system works. The innocent go free and one is innocent until proven guilty.

19. Perhaps, but really unlikely it would ever happen.
Penalties for false reporting are relatively low, and have to be otherwise you'd be charging people over everything.

Ironically, the way the system is set up gives more benefit of the doubt to false accusers than actual rape victims. Beat that.

In this state a law went into effect that charges couldn't be dropped by the alleged victim. Makes sense in cases of actual ongoing violence right? But then obvious false charges could not be dropped either. So on the day of trial - but not before - charges were dropped. Too many different and impossible stories. Oh yeah, she was trying to get out a a pre-nup. No other motive.

17. I'd like to know why it took years to finally do the DNA -- this guy was
swinging in the wind for way longer than he had to. Honestly, the court system/cops/judges are so messed up.
