Fun with the future: Ensuring a woman's right to choose
I'm not ready to make a call on the election, though I feel very good about Obama's current position. If he wins, to the victor belongs the spoils. The judges who are generally on our side are Stephen Breyer (70), John Paul Stevens (88), Ruth Bader Ginsburg (75). All three are quite old.

Some of the wingnuts on the court are considerably younger. Clarence "Pubic hair" Thomas (60), Samuel Alito (58) and John Roberts (53).

This is a problem that hopefully Obama will be able to address. We need some young justices on the court who will be around for a long time. The question I have is do these judges wait around to see who is elected to decide whether or not they intend to retire or do they simply push on regardless of their age.

If Obama wins, he's assured one term. Four years. That's not a lot of time. My hope is that some of these older judges that tend to lean a little to the left decide that it's time to hang it up and let the next generation take over. I would hate to see Obama go 4-8 years and not be able to have an impact on the court.

1. Ginsburg has had cancer and is holding on by a thread. Breyers and Stevens
have also had health scares. When Obama wins, they will hang it up pretty quickly -- they have a constitutional law scholar to pick their replacements and that will add to their legacy.

Isn't Biden also a professor of constitutional law?
