I have been saying this too. He should sue them for libel and slander.

suing now would just bring the whole issue to the forefront again, and hurt Kerry's candidacy.

6. I talked to my partner the lawyer about this
She said that probably the reason they haven't done it is that the standards for proving slander/libel against a public figure are very high ("because of the first amendment") and it's hard to prove in a court of law. And, as she said, if they didn't get convicted, the public would assume that the charges were true, when in fact all it would mean was that they weren't able to meet the legal standard for slander or libel.
