Nebraska Supreme Court won't review sentence of short molester

LINCOLN - The Nebraska Supreme Court has refused a request by the attorney general to review the sentence of 10 years intensive supervision given a Sidney man who molested a 13-year-old girl.

Last month, the Nebraska Court of Appeals upheld the sentence given Richard Thompson after his sentencing judge said she feared for Thompson's safety in prison because of his small stature.

Thompson, 52, is 5-foot-1 and weighs about 100 pounds.

The Court of Appeals said probation was justified by many other factors in Thompson's case, including a psychological evaluation and a risk assessment instrument that indicated Thompson is not a pedophile and is unlikely to reoffend.

Attorney General Jon Bruning, who disagreed with the Court of Appeals' decision, asked the Supreme Court to take up the case. The state's highest court declined to do so in a brief order entered Wednesday.

4. From what I've read and what I've been told prison wouldn't be a safe
place for someone fifty pounds heavier and 8 inches taller.

He shouldn't have hurt that child. That's all it would have been necessary for him not to have to worry about his safety in prison.

So he molested a 13-year-old but he's not a pedophile? And he's not likely to reoffend? :crazy:

I've seen some 15- and 16-year-olds that could easily be mistaken for 10 years older, but never a 13-year-old.
