4. Day One on DU and I'll get flamed for this
* did not violate the law by spying on terrorists. The Constitution gives the President the authority to defend national security and has been upheld as settled law. Carter did it without a declaration of war or court approval. Clinton did it as well. Jamie Gorellick (can't spell) defended it in the Senate for Clinton.

We look stupid ranting and raving about something that is totally legal. In fact, * did it with court approval and with a Congressional declaration of war against terrorists. In fact * did it with greater restraint than Carter or Clinton.

5. Rush lied to you when he said this
Go read the orders Clinton and Carter signed - both stated that the spying could absolutely NOT be used against American persons or citizens.

Your gullibility and ignorance are disgusting - take you talking points and go back to free republic, or at least bring some truth to your assertions.

Web address to Executive Order signed in 1995. Now before you say the Order says nothing about citizens, since it directs the Attorney General to conduct these searches they must occur within the borders of the US. DOJ cannot go to foreign countries without an invitation. Foreign searches would have to be clandestine agencies. http://www.fas.org/irp/offdocs/eo/eo-12949.htm

You said nothing about physical or electronic searches only spy. The gov't can "spy" on us for no reason. Not trashing you I was just addressing a specific point and wanted to clarify what Big Brother can do to us.

See Executive Order 12949 William J. Clinton February 9, 1995. Absolutely NO mention of prohibition regarding American citizens. You said something about truth, ignorance, gullibility?

13. Not in 12949 which is what we are talking about
Unless you got it from a third party that changed the text. I have re-read it four times and haven't seen any exclusion for citizens. I've attached in case you weren't able to follow the link.

EXECUTIVE ORDER 12949

FOREIGN INTELLIGENCE PHYSICAL SEARCHES


By the authority vested in me as President by the Constitution
and the laws of the United States, including sections 302 and 303 of the
Foreign Intelligence Surveillance Act of 1978 ("Act") (50 U.S.C. 1801,
et seq.), as amended by Public Law 103- 359, and in order to provide for
the authorization of physical searches for foreign intelligence purposes
as set forth in the Act, it is hereby ordered as follows:

Section 1. Pursuant to section 302(a)(1) of the Act, the
Attorney General is authorized to approve physical searches, without a
court order, to acquire foreign intelligence information for periods of
up to one year, if the Attorney General makes the certifications
required by that section.

Sec. 2. Pursuant to section 302(b) of the Act, the Attorney
General is authorized to approve applications to the Foreign
Intelligence Surveillance Court under section 303 of the Act to obtain
orders for physical searches for the purpose of collecting foreign
intelligence information.

Sec. 3. Pursuant to section 303(a)(7) of the Act, the following
officials, each of whom is employed in the area of national security or
defense, is designated to make the certifications required by section
303(a)(7) of the Act in support of applications to conduct physical
searches:

(a) Secretary of State;

(b) Secretary of Defense;

(c) Director of Central Intelligence;

(d) Director of the Federal Bureau of
Investigation;

(e) Deputy Secretary of State;

(f) Deputy Secretary of Defense; and

(g) Deputy Director of Central Intelligence.

None of the above officials, nor anyone officially acting in that
capacity, may exercise the authority to make the above certifications,
unless that official has been appointed by the President, by and with
the advice and consent of the Senate.
