Frist speaking on Senate floor today said that he could still
use the nuclear option. Reid answering him saying he was tired of this threat, it has already been decided, move on.

Frist was still trying to gain control through threats and intimidation and Reid basically told him to shut up.

Can't wait to read the transcript. Pretty damn good.

17. Agreed!!! I so hope he tries again!
Move on over to door number 2 and try to go nu-ku-ler with our next contestant on "Who Wants to Be a Federal Judge!" He won't have the votes, and the attempt to change the rules with a cowardly back-door procedural vote will flop, setting a precidence for all future votes and making it clear to everyone just why the filibuster is so important. Unless the Repub-Mod7 go back on their word and vote with Frist right after promising not to, which would make them liars and again expose the Repubs, even the "moderate" ones, as a group of power-hungry thugs that cannot be trusted with governing our country.

To quote your pResident, Mr. Frist, "BRING IT ON!!!"

15. Graham and Dewine
Both Graham and Dewine stated they would vote for the nuclear option if the dems fail to live up to the agreement and filibuster centrist judges. While driving to lunch I heard Graham state (on Sean Hannity -- I am just a political junkie and have to listen to the other side to keep tabs on them) that Miguel Estrada would be acceptable as a nominee and if the dems filibustered Estrada, Graham would vote for the nuclear option. Think about that -- Graham would support Estrada for a SCOTUS position and would trigger the nuclear option if the dems filibuster him. Doesn't sound like an iron clad deal to me.

All this agreement did was postpone the fight until Rehnquist and Sandra Day O'Connor retires. There will be a major battle and the pressure will be enormous. I doubt that Graham, Dewine and Warner will vote against their party leaders if AWOL nominates anyone left of Hitler for a seat on the SCOTUS. In the meantime, we approved three right wing whack jobs for lifetime appointments to the appellate court. We may have blocked Saad and Myers, but AWOL will surely find a couple other Neanderthals to take their place.

Doesn't the agreement allow for each individual Senator to decide for themselves on any future nominees? Lindsey Graham has basically admitted that he will not abide by the agreement, and is just setting up an excuse to break his word.

16. Here comes the Judge?
What if Frist brings the other two judges, Saad and Myers, up for a vote on the Senate floor? They were not included in the compromise so the Dems are put in the position of breaking the agreement or really appear to roll over.

The Dems better do everything they can to slow this process down. Reid is already saying there is no time to vet these judges and let's move on.

18. Saad and Myers deal
Graham stated that all nominees will be dealt with in the manner that was used prior to 2002 when we started using the filibuster. He also stated that any nominee who made it out of committee will get a vote on the floor of the senate. He also stated that at least one nominee would not be approved for ethical reasons. I understood this to mean:

1. Saad appears to have the ethical issues (FBI info) and most likely will be stopped in the judiciary committee. Graham and Dewine sit on this committee and probably agreed to stop Saad, therefore avoiding a floor vote (and filibuster) where he would probably be approved.

2. Myers is already out of committee and I would not be surprised to see him voted down on the floor. Maybe the 7 repubs agreed to stop his nomination in a floor vote. Myer is anti environment and it would be easy for Snowe, Chafee, Collins, Warner, Graham and McCain to stop him on the floor. This group may also persuade AWOL to pull the nomination to avoid the embarrassing loss.

3. Griffin and the 3 judges from Michigan will be approved - we never really opposed these judges on philosophy.

The remaining nominees will most likely get a vote on the floor and all bets are off on these folks. It is unclear whether a side deal was made on these nominees.

I certainly hope they were able to come to a backroom deal because another thread indicates Frist may bring Myers up for cloture by the end of the week.
