...Democratic Senator Tom Harkin...said that Martinez had handed him a copy of the memo on the Senate floor. This caused Martinez to interrogate has staff, and an aide named Brian Darling confessed that he authored the memo. The story, as related by Martinez and his staff, is that Darling wrote the memo in draft form, and Martinez, thinking it was a standard checklist of arguments in favor of preserving Terri Schiavo's life, then handed it to Harkin. link But Darling is Martinez' legal counsel, not a low-level "aide." It has yet to be explained how the memo got into Martinez' pocket, especially since Darling claims that he doesn't know "how it got printed." And it should be pointed out that the talking points have turned up in Republican public statements on at least three occasions.
Consequently, I beg to differ with the second sentence in the first paragraph. And given that Martinez referred to the memo as talking points in progress when he gave it to Harkin, I think he's the real culprit, and that it was decided that Darling would be the fall guy because he has ties to Tom DeLay.
