yet I remember some very sticky and seemingly intractable provisions in the Constituion which specifically state that the federal election MUST be held on the second Tues. in November being referred to back in '00 when a revote was suggested in Florida.

OTOH, in the beginning of the exposure of the potential fraud inherant in the BBV machines, people pointed out the the law requires two absolute factors regarding voting pocedures. . .that the votes be both anonymous and auditable. In that regard, electronic voting machines are illegal or at least that's what some have said. I'm guessing totally but perhaps the greatest legal angles Kerry could possibly take are to prove disenfranchisement and lack of auditability of BB votes. If they can prove that potential illegality then the revote issue could possibly be appealed.

Interesting too that Rehnquist may just be out of commission if legal disputes were to escalate to the SCOTUS. Then there were 8. . .?

What a mess though. Woosh. . .Glad I'm not in David Boise's sneakers today.
