Registered gun dealer to plead insanity in fatal bar shooting

A rural Glenbeulah man accused in a fatal bar shooting last summer is pursing a plea of not guilty by reason of mental disease or defect – commonly called an insanity plea – his attorney said today.

The revelation came as the trial date for Frank S. Hvizdak, 63, was moved from May 16 to September at the request of his attorney. Defense attorney Michael Hart said he is awaiting the report of a doctor who evaluated Hvizdak and plans to enter the new plea May 18 if the report is favorable.

Hvizdak is charged with first-degree intentional homicide for allegedly firing four shots into Jason TenPas on Aug. 31 during an apparent argument at Racer’s Hall, W4408 Highway C in the Town of Sheboygan Falls.

TenPas, 31, of Cascade, died at the scene. Hvizdak has been jailed since the shooting in lieu of a $750,000 cash bond.

5. when you think about the cost per drink
hassle of getting home afterwards, etc it is more sane to just buy at the store and hang out with your SO, listening to music at a reasonable volume at home. On the other hand, sipping a soda and meeting interesting people is always interesting.

7. No concealed carry in Wisconsin - until November
The gun was being illegally carried, the shooter did not have a concealed carry permit and from what I can tell he was also drinking. Three felonies for one incident.

Perhaps another anecdote from a state that actually allows CCW in restaurants that serve alcohol and a real CCW permit holder would support your point a bit more?

10.  You are not a criminal
until you commit a crime. When apprehended for committing a crime, you will face the prescribed punishment. That is the way it works in a free society.

IMHO, the shooter has seen his last day of freedom which is a much better deal than he gave his victim and serious justification for the death penalty.

When you commit a crime, you're a criminal and you get punished and shit.

As to your conclusion, the death penalty is actually one of the few things I agree with your side about.

11. Not in defense of Hvizdak, but your comment at the end of
the OP is curious. There was no mention of his size in the cited story or the reader comments. Do you know him? Is this your own generalization?
