Gun charge nets trick-or-treater killer 16 years

16 years sounds a little light. I hope other charges are filed. Oh no an AK47.

T.J., wearing a ghoulish mask like his brother, sprinted onto the front porch and knocked. Inside, Patrick's girlfriend peeked out the window and screamed there were three large men in masks carrying a rope outside the door, according to his confession cited by prosecutors.
Patrick grabbed his AK-47 from the kitchen. It had been modified to keep firing with just one pull of the trigger. He emptied the magazine, firing 30 shots into the front of the house, according to court documents.
"T.J. Darrisaw ran up so he could be the first in line for the candy," federal prosecutor Stacey Haynes said. "Unfortunately, he was the first in line for 11 shots."
T.J.'s father and 9-year-old brother were struck twice and survived. A third brother was not hit.

3. It was already illegal for him to have any gun. He was a drug dealer.

Inside, investigators found $7,500 in cash, about four ounces of powder cocaine and items needed to turn powder cocaine into crack, prosecutors said.

Patrick wasn't supposed to have a gun because of felony drug convictions.


Additional gun controls laws would not have stopped him from having a gun.

Further, if his AK was actually modified to fire full-auto, then that was another gun-control law that he broke.

8. How the HELL did he get only 16 years?
Possession of an unregistered Title 2 AK-47 is generally an automatic 10 year felony (the same as if he possessed a bomb). So, what, he got only an additional 6 years for murder and attempted murder? WTF is up with that?

Or did the gun charges get plea-bargained away to nothing, like they always seem to be for everyone EXCEPT people with clean records and no criminal intent?

Or are these just the state charges? If so, 16 years is still too light for murder, but he could still have a Federal trial on the possession-of-a-machinegun and felon-in-possession charges.

It says he got the 16 year sentence for being a felon in possession of a firearm.

It also says he is STILL GOING TO FACE MURDER CHARGES.

"But the 16-year, eight-month sentence handed down Monday was just 20 months more than the minimum Patrick could have faced after pleading guilty to a federal charge of being a felon in possession of a weapon."
"But Patrick still faces murder and assault charges in state court, and prosecutor Kelly Jackson said he will decide what to do about that case later. Jackson said Patrick could face 30 years to life in prison if convicted of murder."
