Interesting Constitutional issue.

Could Santos just appoint a replacement or following an election did his or for that matter any President's elect choice have to go through the regular process, Senate confirmation?

Section 2 of the Twenty-fifth Amendment provides that:

Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.

16. They discussed that.
First trip wire: Legally Santos wasn't the President. Did that mean a wait until he was sworn in. Second problem, if God forbid anything happened to Santos between election and inauguration, who then would take his place.

Stretching the 25th to the limit, POTUS elect names his choice and choice goes thru the confirmation process, but potential legal and practical land mines waiting to go off.

Following the death of McGarry on Election Day, Santos chooses Baker for the Vice Presidency, eventually deciding to submit Baker's name to Congress under the terms of the 25th Amendment, rather than asking the Electoral College to vote for him. The series ends without stating whether Baker is confirmed, but Santos is confident that he will be confirmed due to his plan to threaten the Republican Senate with an electoral college vote in order to make them promise a quick confirmation, and due to the presence and influence of Arnold Vinick in his cabinet, who has agreed to be his new Secretary of State.

implied but they never specifically showed it. I would have loved to have seem Ed O'Neil become VP, even if it was only on TV. ;)

At least I don't think so, but I could be wrong.

And I miss it too. Although we saw it come to life with the Obama campaign. Go back and watch some of the episodes where Santos is giving speeches (like his announcement that he is running). Team Obama must have really paid attention to that episode.

13. I read just the opposite...
...that Lawrence O'Donnell, who wrote for the show, got his Santos inspiration from Obama, not the other way around. Loved that show.

A show about what the US would look like if the Democrats were real Democrats.

These days, it's hard to watch -- I have all the DVDs -- because the show's idealism clashes so horribly with real life.
