So, that was fun...I just entered my Condo with my GUN drawn...(yes, I am serious)
so, lately due to the crime and violence rate in the 'hood going up, I have been carrying. I am licensed and it is legal, before anyone objects, Minnesota is a must-issue state...

Anyway, I come up the stairs to see my door open and I hear voices inside, so I draw my gun and ease up to the door. Upon entering (a quick entrance I might add) I see two strangers standing in my living room and I immediately order them to the ground at gunpoint. once they get down and I order them not to move, I dialed 911 on my phone (luckily the iPhone has emergency calling via one button press when locked) and tell them I have two intruders inside my house, on the floor being held at gunpoint and am requesting the police come and arrest them.

it is amazing how fast the police respond when they hear a gun is present... Anyway, the police come I put my gun away and the two strangers tell the police they are on the condo association board and are doing health and safety inspections... :eyes: First of all, no one told me, and second no way in hell they can just walk in whenever the fuck they feel like it without telling me first...

The police took the report and are sending them to the prosecutor for potential charges of unlawful home invasion, and they arrested the two people that were inside my condo for the same charge. They can try and explain it to a judge tomorrow, and thank their lucky stars I have control over my trigger finger...

No shots were fired. I think I need a drink.

I am also changing the locks tomorrow, and NO ONE on the condo association board will have a key.

13. I was in Minneapolis for a convention just after they passed that law, I think.
There were signs in all kinds of business' windows saying guns were not allowed in the restaurant, bar, hotel, store, etc. Made me wonder what was the point of having guns at all, if you can't take 'em anywhere.

17. I have a locked carry case for it that I carry in the car
most of the time, I would say 99% actually, it is in there, only when I am walking round in my 'hood is it on me. When I get inside my condo, it gets locked back up in a safe too.

and a two handed grip on the weapon. unless you are former military or LEO, the average person doesn't have the skill to keep cool in these situations. even taking your attention away for 3 seconds is enough for someone to disarm you, but this depends too on the layout of the room, what cover you had, and the suspects' position in the room.

good move on getting them on the floor. did you have them spread their arms out or interlace their fingers on their heads?

I was shortening neighborhood to just 'hood. I live in Uptown, which is a very nice part of town, but there has been quite a bit of gunfire here lately.

The Velveteen Ocelot knows where I live, you can ask her if this is the 'hood or not...

apartment(not even a condo)without verbally warning me 24 hours in advance.Totally

illegal.The only exception is in case of emergencies like fire and so on.But

He works for a condominium management agency; and some of their properties are in crime-ridden neighborhoods. It'd be good for them to be aware that ample notification needs to be given before performing inspections. I would think they'd be smart to inspect when residents are actually home.

52. Glad nobody got disposed of, but I'd have
taken a position at the landing below my door and just called the cops. If the crims came out, I'd get them down. Otherwise, I'd rather the cops do the work. That way I don't 1) have bodies on my gun; 2) get sued; 3) have to clean up blood spatter; 4) have to live with having hurt/killed someone.

See, even in gun ownership, the vegan in me overtakes.

Condo management. They were trying to do their jobs, and suddenly they're looking down the barrel of James Bond's preferred weapon of choice.

If they were criminals and weren't also trying out your $700 dollar headphones while you arrived, chances are they'd hear the key in the lock turning, and draw their own weapons and fire away towards the source of the noise, bad neighborhood as it apparently is. Of course, you wouldn't have known that until you entered "quickly" and got them on the floor. Kudos to you.

Of course, being criminals, and audio troglodytes, they may have put on a vinyl record and misinterpreted the clicks and pops or your key unlocking the door as part of the music, giving you stealth mode while you unlocked the door. In that case, you are a true Ninja!

Perhaps you missed a letter stating that people would be by in the next 24 hours, and you're looking at a big lawsuit.

IF this happened as the OP said, then there was a letter sent. Condo HOA know the laws, and what they can and cannot do -- the open door bears this out. And, depending on the state and teh Condo Corp laws, the Condo Board can pretty do whatever the hell they want.

However, I tend to think DS1's statement isn't hogwash, but I do believe other statements on this thread are hogwash.

I'm not judging the veracity of the OP, I'm just taking it for what it is. I could care less if he is who he says he is or if he is telling the truth - it's not my job to be net nanny, to protect the sanctity of the lounge and DU, to feret out the pretenders - to decide who is funnier, what humor is better, which tale of woe is worthy of compassion, etc - there are plenty of folks here that post nonsense, so what.

Now to the "hogwash" comment. Based on the OP, your reply to me assumes facts that do not exist. You assume some notice was sent when the OP said it wasn't. Taking the OPs story as it is, the people in his home without permission were trespassing. He had the right to detain them and call the police as he did. The alleged trespassers were violating the law, they had no right to enter without permission. The OP didn't go in blazing - he didn't harm the trespassers so the "duty to retreat" nonsense doesn't come into play. Have you ever heard the term "citizens arrest"? That is what he did, he detained the criminals until the police could come and arrest them for real. The trespassers have suffered no damages at the hands of the OP so they have no lawsuit - thus the hogwash comment is correct.

I went through a very similar scenario a couple of years ago with my apartment - apparently, someone from the management company had left a message on my cell phone to let me know someone was to look at my place the next day. This message was left late on a Friday afternoon, and I was at work with my phone off. I left work and played golf until dark, and just came home and went to bed after a quick dinner.

The next morning, I was just kind of lolly gagging around the place when I suddenly heard a key turning in the lock. The door swung open, and there were three people standing there, including one from the management company. Good thing I wasn't "loaded for bear", as the expression goes.

73. You are the one person the lawyer in your CCW training is talking about who should not have a permit
you had a duty to retreat in this case....this was NOT your castle law (where you do not have to try and get away via some other exit..in your home in states with "castle laws" you do not have to try to get away..ie running out the back door, jumping from a window, etc...BUT, you would have had to have actually BEEN in the home at the time).

Had these idiots come in while you were IN the condo, have at it, make your warning, call 911 if you can and then hold them until the cops come. Of course, if they had backed out of the condo when you warned and displayed your weapon, you cannot chase them down the road with your weapon because your threat does not exist anymore.

In YOUR case, you created a threat, had a duty to retreat, and even though these idiots were in your home under Condo authority (maybe the letter blew off your door, I don't know, maybe they were stupid and never sent it) they can very possibly sue you for emotional distress because you did not follow your states CCW rules by NOT entering the premise. You were in no danger outside the condo, you could have easily removed yourself to a safe area and called 911, and your CCW does not give you authority or license to protect personal property. If a thief snatches your watch, and runs AWAY from you, you cannot cowboy down the street after him waving your gun and warning you are going to shoot if he does not stop. Imagine some other fool watching THAT scenario, seeing you chasing a man with your gun out, and violating THEIR CCW training by insinuating themselves in a No-No third party situation by shooting your ass because YOU had the weapon.

You need a refresher course pronto on CCW in Minnesota, and you better hope these two do not consider checking in to your state's CCW rules...you probably ought to make a quick consult with your attorney as well, in case they DO. Now, will some stupid incident like this every happen with your condo association again? Probably not. That said, seriously, if they pursue it, even of they were in your home, lawful or otherwise, this would be an attorney dream case on quick settlement....NOT on your favor either. Plus, you memorialized it on a message board, even more evidence against YOU.

And for the record, I carry a CCW permit, carry a Ruger 280 LCP as my personal gun (others in the home are different and larger). I have also sat through hundreds upon hundreds of hours of CCW classes as a safety officer in those classes, and have a parent who is certified to teach CCW and DOES it for a living (I sit in as a safety officer during class and work the range during target training). I listen carefully during the classes, as the rules in our state DID change...and to see before hand whom to watch carefully on the range....before in my state you had a duty to retreat from your home, that is no longer true, we have the "castle rule" now, and the actual rule stating HOW you can conceal changed (all to get more reciprocity with more states who considered our state to not have a "true" CCW law)

To cover your misunderstanding of the fact that the poster memorialized he was not in the house, and WENT in to escalate a situation. Being an expert on criminal law, you know his scenario can actually result in criminal charges if pressed.

He cannot do what he did, even in Minnesota. And you cetrtainly know he absolutely cannot do it this way in Ohio either. He will be LUCKY if he does not get any criminal or civil charges filed against him, if the story is as he says. Hopefully, the folks involved will be nice about it and understand his overreaction.

If it turns out that for whatever reason those people had a right to be there, then son you are in a world of hurt. You'll be lucky if the DA doesn't charge you with reckless use of a weapon, and if you don't find yourself on the losing end of a civil lawsuit, not to mention the trouble you're going to have with your neighbors and condo association from now on.

Even if the people didn't have the proper permission to be there, you still didn't have the right to hold them at gunpoint under those circumstances.

You know, the door being left wide open, the lights turned on and the fact that you could hear their voices should have been an indication to you that the people in the place weren't trying to conceal criminal activity. Unfortunate judgement call on your part.

Then maybe you'd be scared enough to drop to the ground but the whole time you'd be saying, "Fine, call the cops, we're just doing our jobs here."

Did they stay silent the whole time it took for the police to arrive (which here in Atlanta could be a LONG time!) or would Pierre be yelling for them to stay silent?

According to most condo corp laws (and, they are generally state statutes), Association members can enter for specific reasons. If they could prove who they are (and according to the OP, they were who they said they were), then they wouldn't be arrested.

130. These kinds of scenarios are the exact situations that a good instructor
has for the class. The classes I attend/assist with all have a lawyer present two - three hours of stuff like this...bringing all type of situations into the classroom...letting students bring their own "what ifs" into the picture. I also love the "intruder drill"...having the students go home and prepare a written out drill for if there is an intruder in the home, with different scenarios, like if you have guests, what floor you are on versus where your guests or kids are at; and how to ALWAYS have your cell phone charger by your bed, gun NOT under the pillows, etc.

IMO, twelve hours of class/target is NOT enough. I think it ought to be a couple weekends at least, make it more like 25+ hours or more.

I think the CCW course should be much more involved, longer, etc. I have yet to take it here, but it took me 5x as long to get my title agent license than it will to get a CCW.

there is always one in every single class...you can spot them from a mile away, that will pull that gun out on a whim. Whenever you take the class, let me know if you find that person....you will, trust me.

And using a gun to hold anyone that has not threatened you is a violation of all CCW rules that I know of. You are not allowed to escalate or initiate the danger.

Only a peace officer can hold someone at gunpoint over property, etc

Of course, you knew that, that is why you said that upthread....you will enjoy the class when you take it.

Wow. What an experience. The police arrested people from your condo board for home invasion? Is it a large association? You can expect a war within your association, because those things can be quite political--I hope things don't get ugly.

They are required to give you a 24 hour notice to gain entry, unless it's an emergency like a fire or a burst pipe ( I know from experience). What did they say to the police? Did they say they didn't need to provide notice, or did they claim that they did give proper notice of entry? What did your neighbors say? Did they inspect your neighbor's homes and did they receive notice? It seems strange that this would happen an night too. Did the Police chew you out for not calling them first?

I can't wait to see how this will be written up in the Wedge and SW Journal's crime reports. While this was several years ago, it was wild to see my purse snatching written up in such clinical terms in those papers.

112. Our neighborhood papers write about all arrests and local crime, no matter how mundane.
They have maps and legends that include incidents of under aged drinking, purse snatching, indecent exposure or CDs stolen from an unlocked car. All I'm saying is that if this did indeed happen, it would show up in the SW Journal and the Wedge newspapers and this would probably cause a major scandal. For the Mpls Police to arrest people from a condo board doing an inspection for a "home invasion" and not let them off with a warning (if this did happen) would in fact cause a huge scandal for police overreaction especially if a weapon was supposedly drawn. That's why I asked all of my questions about neighbors and if they were notified. Here are links to our crime reports, which are updated weekly, so this incident would appear next week.

110. Good for you sir.
I hate it when people from the apartment complex like to come in when you arent home. They did that once and I raised a big stink about it. Now I make sure that at least one of us is home at all times (theres 3 of us) and the top deadbolt is always locked. They used to try to come in and leave notes and shit or have the exterminator come in and spray during the day. They dont try anymore but it took a lot of screaming at them.


I hope the people at your condo learned their lesson.

127. About six years ago something similar happened to me, only there was no gun involved
and nobody was inside the apartment. I came home one day ( at that time my apartment was directly across the street from my work ) the door was wide open. Of course, I'm a little nervous because the first thing I think of is I got robbed. I just stopped at the entrance and listened for any activity..called out,too. I went in...nothing out of place,nothing missing, nobody there...

Turns out that the maintenance man let in a guy who was a prospective buyer for this property ( which include two other apartments ) just to check out the space and possibly bump up the rent. The maintenance man never locked the door....it was an old door that you had to pull shut and lock the deadbolt since parts of the frame were warped. Needless to say, it still freaked me out.

Hope you don't get shit for this
