12. hmmmm, here's a thought
Using this definition, one can see clearly that the man in the photgraph is experiencing an emotional response to the shrubbery.

Would this make the photo art regardless of the interpretation of the viewer of the photograph since it documents another's emotional reaction?

If it elicits an emotional response, then it is art.

I can't tell from the picture whether the observer experienced a transcendental emotional event or mild indigestion.
