1. "News" program
The FCC considers The Tonight Show to be informational in nature, so they're exempt from "equal time" provisions. Saturday Night Live is considered an entertainment program, so they must offer equal time.

Same deal with Howard Stern. He's classified as an informational program because of the interview segments.

or does that matter re 'news' vs. 'entertainment'?

are guests on spin shows paid? or just those like mAnne Coulter?

5. the equal time law makes no sense
Interviewing one candidate in a flattering way while ignoring the others
isn't considered an equal-time violation.

But the unusual circustance of a candidate appearing in an entertainment program is considered an equal-time issue.

Most candidates would rather that they get to do flattering interviews while their opponents are ignored.
