5. Here's my thing.
I think she should have been more discreet. Put them on a computer and delete them from the phone. But, whether she is at school or wherever, that phone is still her personal property. Those kids had no right to mess with her phone. They should have been penalized for doing so.

This is ridiculous. Did this teacher have no expectation of privacy?

I would probably not put nude pictures of myself on my cell phone but if I did, would I have to worry about losing my job over it?

I really get ticked off when they act like they can control our private lives. (Hee hee -as if I had a private life. Most of my 'free time' I spend grading papers.)

7. We had a teacher in my district

who was suspended when one of her students stole her keys from her purse. She had one of those little mace squirters on her keychain and the kid maced the classroom. No, the kid didn't get suspended. They had to evacuate the building and one of the neighbors called the media. So the teacher got suspended.

And a friend of mine got reprimanded last year when some kids took the door off the hinges of her classroom and came in and stole her purse. When she reported it, the principal wrote her up for failing to have control of her class. Here's the kicker - it was her planning period and she wasn't even in the room. Plus, the kids weren't even her students.

School administrators - not the sharpest knives in the drawer :crazy:

8. As long as the sex wasn't with a student what's the problem?
As a side note has anyone else noticed that all the teachers,female,that get caught having sex with students are hot.I don't know if I would have considered it abuse if it had happened to me in high school.I would have had a different term for it.

she brought pornographic footage onto school property and negligently permitted students to see it.

a wrongful termination suit certainly has some merit, but it's not a slam dunk.

but are there laws against bringing pornographic materials onto school grounds (well, or school policy)? I think the fact that they stole the phone (which they should be suspended for) is a mitigating circumstance. i dunno, though :shrug:

but the fact that they stole the phone, for which they should, indeed, be suspended and/or prosecuted, doesn't necessarily get the teacher off the hook.

what teachers do in their off-duty is certainly their own concern. my mother is a labor lawyer and has handled a fair number of wrongful termination cases. typically, they involve teachers getting fired for something they did on their own time, off school premises, and those she wins or settles favorably.

but on school premises, during school time, is another matter.

certainly, if a teacher was found to be circulating pornographic material among the teachers or other adults at school, or was found masturbating to pornographic materials, that would make the case very difficult.

there would be a tendency to presume that if the teacher brought the materials onto school premises, it was done for a reason. so the teacher had better be able to show that there was no such intent, that the phone was merely idle storage for private materials with no intent to be used on school property.

anyway, the big thing is the language in the employment contract, union contract, and/or local and state laws.

24. I agree, but...Texas is an 'at will' state. hard to sue...REALLY hard.
at least as i understood it when I was the one doing the hiring and firing, many moons ago.

also, isn't it great when your hometown makes it to the news for something so stupid? :-) good ole san antone. btw, Judson is a HUGE school, I mean H U G E. I am surprized this was a big deal at a school that large, don't they have bigger things to attend to?
