Is it an FCC violation to broadcast while intoxicated? (Rush)
What is the penalty for this?

Rush has been intoxicated on the air (hundereds?) (thousands?) of times...

More than likely, he is soaring on methadone or some other "alternative" fix today...

I seem to recall that it is an FCC violation to be drunk or stoned on the air...

...anyone have info on this???

2. Interesting question
Don't know the answer without doing some research .. but
one night I did hear a radio announcer on the air who was obviously sheets to the wind. They had someone come in and take over her show that night and she was fired from the station.

The only reason I have not alerted you to the Mods is that I think you are kind of funny...

I am obsessed with the right-wing strangle hold on the media- any Democrat who is not is asleep.

I have heard many a drunk guest on Howard Stern. Although Howard is probably a bad example of FCC compliance.

Hary Carey (Cubs) definitely had a few pops on his broadcasts back in the day.

That line of Rush's from his "triumphal return" just really pisses me off, because it's phony in itself, per se! Of course he was being phony if he talked up maximum sentences for drug addicts/criminal possession/etc. WHILE HE WAS HIGH HIMSELF. Of course he's just PURE PHONY BALONEY ALL THE TIME!!!!!

Obscene speech is not protected by the First Amendment and cannot be broadcast at any time. To be obscene, material must meet a three-prong test: (1) an average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest; (2) the material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and (3) the material, taken as a whole, must lack serious literary, artistic, political, or scientific value. See Miller v. California, 413 U.S. 15 (1973).

Most of us would agree he is obscene. You could always file a complaint and see what happens.
