Is Janeane really advocating for having sex with minors?

The guy she is talking about was not jailed for being gay, he was jailed because he had sex with a minor. Can anyone say NAMBLA?

What the fuck? Am I just "not getting it"? Why should the fact that the guy was gay, mean he shouldn't do jail time for having sex with a minor? If I have sex with a 15 year old, I go to jail... Same for everyone. What the fuck does being gay have to do with anything?

When I was 18, if I had sex with a 15 year old girl, I'd have served jail time...

3. it was only a 2.5-3 year difference...
Inappropriate...maybe, but deserving of a lengthy jail time...no. Thats like a High school senior dating a Sophomore. I saw that all the time when I was in school.

5. That wasn't what Janeane was talking about
Many states have "Romeo and Juliet" laws providing for lighter penalties if, in a statutory rape situation, one party is only a year or 2 older than the other. That was the case here, where one boy had just turned 18, and the other was about to turn 16. Kansas' statute specifically exempted homosexual relations from this "Romeo and Juliet" provision under their law, so the older boy was sentenced under the regular guidelines, which sent him to prison for 17 years, as opposed to the 2.5 he would have been on the hook for if his partner was female. The Kansas Supreme Court (properly) deemed this a violation of the "equal protection" clause and thus unconstitutional, and that's what Janeane was talking about.
