Miller's story actually trumpeted Roberts, and put Delay on the back burner last night on various news channels. Might have been just a case of wag the dog? who knows...

how about lining up your ducks? 1.With the court back to 4/5 decisions odds are better for any appeal. 2.Having the Chief Justice in place is a smart move prior to the drum-beat for impeachment. If Miller's testimony came prior to the confirmation of Roberts' and endictments resulted, choosing the justice who would be presiding over the hearings could be a bit more contentious.
