Just reading the Constitution. Question on recess appointments.
"The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session."

Couldn't that mean the vacancy had to occur during the recess?

The intent of the authors of the Constitution is pretty clear.
