Investigator Quickly Learned 'Friendly Fire' Killed Athlete

The first Army investigator who looked into the death of former NFL player Pat Tillman in Afghanistan last year found within days that he was killed by his fellow Rangers in an act of "gross negligence," but Army officials decided not to inform Tillman's family or the public until weeks after a nationally televised memorial service. A new Army report on the death shows that top Army officials, including the theater commander, Gen. John P. Abizaid, were told that Tillman's death was fratricide days before the service.

Soldiers on the scene said they were immediately sure Tillman was killed by a barrage of American bullets as he took shelter behind a large boulder during a twilight firefight along a narrow canyon road near the Pakistani border, according to nearly 2,000 pages of interview transcripts and investigative reports obtained by The Washington Post. The documents also show that officers made erroneous initial reports that Tillman was killed by enemy fire, destroyed critical evidence and initially concealed the truth from Tillman's brother, also an Army Ranger, who was near the attack on April 22, 2004, but did not witness it.

The first report about Tillman's death within Army channels -- sent at 4:40 p.m. April 22 -- said that Tillman died in a medical treatment facility after his vehicle came under direct and indirect fire, attributing the gunshot wounds he received to "enemy forces." An investigation was immediately launched, and several documents show that the local chain of command was largely convinced it was fratricide from the beginning. The next day, Tillman's Ranger body armor was burned because it was covered in blood and was considered a "biohazard." His uniform was also burned. Jones noted that this amounted to the destruction of evidence. Soldiers reported they burned the evidence because "we knew at the time, based on taking the pictures and walking around it it was a fratricide. . . . We knew in our hearts what had happened, and we weren't going to lie about it. So we weren't thinking about proof or anything."

An initial investigation found fratricide just days later. Top commanders within the U.S. Central Command, including Abizaid, were notified by April 29 -- four days before Tillman's memorial service in San Jose, where he was given a posthumous Silver Star Award. Jones concluded that Tillman, who was bravely leading his fire team into battle, was given the award based on what he intended to do. The family learned about Tillman's fratricide over Memorial Day weekend, several weeks later. Commanders felt they could not hold on to the old version because the Rangers were returning home and "everybody knows the story," the documents show.

Army Silver Star Medal," December 15, 1942. For U.S.
Navy and U.S. Marine Corps Service members, authorized
by Act of Congress, August 7, 1942 (Public Law 702).

The Army Silver Star was originally known as the "Citation
Star" and authorized by the same Legislation which established
the Distinguished Service Cross, July 9, 1918. In
1942, the Citation Star was replaced by the Silver Star.

AP1.1.2.12.2. Awarded pursuant to Section 3746 of title
10, U.S.C. (reference (jjj)) (U.S. Army Service members),
Section 6244 of reference (lll) (U.S. Navy, U.S. Marine
Corps, or U.S. Coast Guard Service members), and Section

The Silver Star may be awarded to any individual --
military, civilian, or foreign -- who, while serving
in any capacity with the Armed Forces of the United
States, distinguishes himself or herself by gallantry
in action under any of the following circumstances:

AP1.1.2.12.2.1. Against an enemy of the United States.

AP1.1.2.12.2.2. While engaged in military operations
involving conflict with an opposing foreign force.

AP1.1.2.12.2.3. While serving with friendly foreign
forces engaged in an armed conflict against an opposing
armed force in which the United States is not a belligerent
party.

WASHINGTON — Pat Tillman died while leading a team of Army Rangers up a remote southeastern Afghan hill to knock out enemy fire that had pinned down other American soldiers, the Army said Friday. The Army released details of the former Arizona Cardinals football player's death as it announced that he was posthumously awarded the Silver Star, its third-highest award for combat valor. Tillman, 27, and his team were initially not in danger from the hostile small-arms and mortar fire when the April 22 ambush began. But when the rear section of their convoy became pinned down in rough terrain, Tillman ordered his team out of its vehicles "to take the fight to the enemy forces" on the higher ground.

As Tillman and other soldiers neared the hill's crest, he directed his team into firing positions, the Army said. As he sprayed the enemy positions with fire from his automatic rifle, he was shot and killed. The Army said his actions helped the trapped soldiers maneuver to safety "without taking a single casualty." Walter Sokalski, a spokesman for Army Special Forces Command, said the Silver Star will be presented to Tillman's family Monday during a public memorial service in San Jose, Calif. "It will be presented by members of the 75th Ranger Regiment, by soldiers that knew him," Sokalski said. Tillman was in the 2nd battalion of the regiment, based out of Fort Lewis, Wash.

But according to the details provided Friday, Tillman led his Ranger team that day "without regard for his own safety," and was shot and killed heroically trying to protect his comrades. Tillman's platoon had been split into two sections during a patrol. Tillman, a team leader, was in the platoon's front when the rear section was hit with enemy fire. Because of the rough terrain, "the trail element was unable to maneuver out of the kill zone and it was difficult for the embattled trail section to target the enemy positions," according the Army's description of the events.

During a briefing Friday with Pentagon reporters, Gen. John Abizaid, commander of U.S. Central Command, which includes operations in Afghanistan and Iraq, said he was able to talk Thursday with 1st Lt. Dave Hutman, Tillman's platoon leader. "I asked him about Pat Tillman," Abizaid told the reporters. "He said, 'Pat Tillman was a great Ranger and a great soldier, and what more can I say about him?'"
"When he was talking to me, he was still nursing a large number of wounds that he sustained in that firefight where Pat Tillman lost his life," Abizaid said.

WASHINGTON (AP) -- Army officials knew within days of Pat Tillman's death that the former NFL player had been killed by fellow Rangers during a patrol in Afghanistan but did not inform his family and the public for weeks, The Washington Post reported. A new Army report shows that Gen. John P. Abizaid, the theater commander in Afghanistan, and other top Army officials were aware an investigation had determined the death was caused by an act of ''gross negligence'' four days before a nationally televised memorial service, the Post reported after reviewing nearly 2,000 pages of documents it had obtained.

Tillman, 27, turned down a multimillion-dollar contract with the Arizona Cardinals to join the Army after the Sept. 11, 2001, terrorist attacks. He was taking cover behind a boulder along a canyon road near the Pakistani border when a firefight erupted at twilight on April 22, 2004. The Post reported on its online edition Tuesday night that troops on the scene said they were immediately sure Tillman was killed by a barrage of American bullets.

The documents show that officers erroneously reported that Tillman was killed by enemy fire, destroyed critical evidence and initially concealed the truth from his brother, also an Army Ranger, who was near the attack, the Post reported. The memorial service in San Jose, Calif., took place May 3, 2004. The Army announced May 29 that Tillman likely died because of friendly fire.

Brig. Gen. Gary M. Jones, who prepared the report, concluded there was no official reluctance to report the truth, according to the Post. But an Army spokesman, Paul Boyce, told the newspaper: ''Notifying families in a timely way that they have had a loved one killed or severely injured is complex and imperfect work. We can do better.''

...and do not take my post as advocating that.

I researched the Silver Star Award requirements to see if the Army had issued it as a ruse, and they appear to have done so.

I am just saying that it would seem to be up to the Swifties to make sure that someone apparently so undeserving of a medal would have it revoked...

8. I'm wondering why this story is resurfacing
I read about his death being from friendly fire many many months ago -- the story about initially being "enemy" and then "friendly" fire. This is old news -- why is WaPo bringing it back up?

This is like pissing on the man's grave. I can't really say that I'm surprised given the tribe of hyenas who think they're currently running the show, but it still doesn't stop my gorge from rising.
