F911 Question -- An Oregon family has charged
Edited on Sun Jul-25-04 11:04 PM by kaitykaity
that MMoore used an image of their dead Colonel's
funeral without their permission.

Has Moore debunked this anywhere? All I can find on
Google is the spurious charge made, I couldn't
find anything in MMoore's War Room on his web site,
and nothing came up in a DU archive search.

Thanks in advance.

edit to fix typos :grr:

1. Do they have the copyright to this footage?
Is there a law requiring their permission before the footage is used?

If not then this may be a breach of etiquette, but not a violation of law.

M. Moore may be rude and uncouth, but not a criminal.

2. And guess what?..Michael Moore is
Not "rude and uncouth", either!

Only one of the greatest documentary makers ever born.

3. can't debunk--Moore did not get permissions
from them. From what I understand, he didn't have to do so--he is within his legal rights. They don't have a leg to stand on--and they need to quit belly-aching and trouble-making.

4. I don't think he is either
only that being "rude and uncouth" is the worst he could possibly be accused of here.

He can't be accused of falsifying his movie.

He can't be accused of having done something illegal.

So he has to be accused of a violation of etiquette.

Someone sick Miss Manners on him! This is serious! (NOT!)

15. Come the hell on.
It's a pic of a FUNERAL, MM is a shithead for doing such a thing. Would you want your son/daughter's funeral to be shown on O'Reilly glorifying his opinion somehow?

5. I think your post is "rude and uncouth", but you may not be that way...
...in real life.

I may be rude and uncouth, but you certainly have no sense for sarcasm, nor any sense of humor.

6. Well, finally a funeral gets some attention
And they bitch about it? They should be honored that the entire world will acknowledge their loss.

Requesting permission would have been nice. But how many hoops does Moore need to jump through before everyone is satisfied?

8. what people don't realize about movie distribution:
There's this thing called E&O insurance. It stands for "errors and omissions". It's very expensive and very involved.

Nobody will distribute a movie without a solid E&O policy.

The E&O people pore over the script (for a dramatic film) and the movie, in a case like this, and EVERY TINY LITTLE THING you wouldn't even think of gets thoroughly vetted.

Without the E&O the film does not get distributed. It's as simple as that.

So the odds that the E&O people missed this one are pretty small. Possible, but small.

9. That's a good answer.
Edited on Mon Jul-26-04 12:59 AM by kaitykaity
The person who asked says it still doesn't answer
her question, so I guess she's going to have to ask
somebody else to help because I've done all I can.

Thanks.

10. What if he did use it without permission? Does it matter?
Unless they copyrighted the footage, I can't see how it does.

What is the name of the funeralee? This may be another instance of an urban legend designed to discredit the filmmaker.

14. The family doesn't have much say in the matter
Whoever took the video owns the copyright.

The family probably did have control over who they allowed in to the funeral. If they had allowed the media in to film the funeral to begin with, then they have no right to complain about it now.
