Jan. of 2002, Powell was still trying to be the Sec. of State. He advised shrub that they should at least determine GPW status on a case by case basis. White House remained "unconvinced" of Powell's argument. Shrub's lawyer does warn of conciquences such as:

"Our position would likely provide widespread condemnation among our
allies and in some domestic quaters, even if we make it clear that we
will comply with the core humanitarian principles of the treaty as
a matter of policy."

"...may encourage other countries to look for technical "loopholes" in future conflicts to conclude that they are not bound by GPW either"

"Other countries may be less inclined to turn over terrorist or provide legal assistance to us"

"A determination that GPW does not apply to al Qaeda and the Taliban could undermine US military culture which emphasises maintaining the highest standards of conduct in combat, and could introduce an element of uncertainty in the status of adversaries."
