Whatever happened from... Bush appointing judges during *recess* & Kennedy
saying it was unconstitutional? Dems fighting back on this one?

1. Recess Appointments
Senator Daschle has threatened to stop all Judaical appointments unless Bush drops the tactic of making recess appointments. Right now there are two recess appointments on the appeals court (Pickering and Pryor). I heard that P. Owen was offered a recess appointment and turned it down.

Senator Kennedy has threatened a lawsuit on the grounds that a ten day break for a holiday is not the type of recess necessary for a valid recess appointment. Someone is suppose to be researching this area of the law. I have not heard on any lawsuits being filed here yet.
