What should Gray Davis Do?

Now that Cruz is in Should Gray Davis resign. Is it is inevitable that he will lose the recall?

Best Scenario for Davis would be for Crus to run....but refuse to campaign, Saying that as much as he is against the Recall....It apears to close to call....The Party has no choice but to field a candidate when with 4 republicans in the race 26% of the elctorate can win.

Runnunin as a non-campaigner means he will not need the $10M from the union necessary.

The argument basically is This is Gray's campaign. If He loses the population may want the Lieutentant Governor to replace him.

1. No, it is not inevitable that he'll lose the recall

He MIGHT lose. What good would come of him resigning? There is no reason Democrats cannot both support Davis and provide a backup candidate in case he loses.

But not everyone here sees it that way. Some see support of an alternative candidate as showing lack of support for Davis. I don't understand that logic.

That might be a good option. Or maybe the deadline has passed, I'm not sure. But the dam has suddenly burst with Arnold, Arianna, and Bustamente.

...it's after the petition has been certified, which is imperative for setting a recall date. In other words, the date of the recall election can only be set after the deadline passes, and since the date has been set, the deadline must've passed.

Once the recall petition signatures were verified there is no way to stop the recall. If Davis resigns, Lt. Gov. Bustamante will assume the duties of the governor and the recall election will proceed. If Davis then happens to WIN the recall, he would not be able to take back his resignation.

5. Presumably what he's already doing.

He must oppose the recall in an electoral sense. He must cite, chapter and verse, where the responsibility for California's budget deficit lies. Clearly and unambiguously.

He must oppose the recall in a legal sense. IANAL, so I don't know when an 'equal protection' challenge to the law would be ripe, nor do I know specifically who'd have 'standing' in such a challenge. I presume only voters would have such standing and the ballot finalized before such a suit would be ripe. I'd guess the first action in such a legal challenge would have to be asking for a restraining order ('irreperable damage' and all that).

If this 'election' is not challenged and overturned on an 'equal protection' basis, I have almost no hope for democracy in our nation in the next decade or more.

One thing is very clear to me. If such a challenge is not mounted and succeeds, then democrats of all stripes must mount such recalls forever and wherever they can. If such specious laws are made available only to the Reich, it's like unilateral disarmament -- an unconditional surrender of democracy.

And ban elections in his state until order instead of 'new world order' is restored!
