Anti-Abortion Ad Provokes Lawsuit
Edited on Wed Apr-27-11 12:59 AM by cal04
Source: Associated Press

A mother sued an anti-abortion group on Tuesday for using her 6-year-old daughter’s image on a giant billboard in SoHo that some people denounced as racist and offensive.

The girl’s mother, Tricia Fraser, sued the Texas group Life Always over the billboard, which went up briefly in February.

Life Always did not immediately respond to a request for comment.

The billboard pictured Ms. Fraser’s daughter, who is black, and the words, “The most dangerous place for an African-American is in the womb.” Some officials called it offensive to women and minorities, and it was quickly taken down by the advertising company.

4. They respect no boundaries. They didn't care about her or the effects. This was no mistake.
They used her image to make money, figured that it was alright to sue her because she was a stranger to them and she was black.

The way they did this, without the same level of respect they'd demand to be shown their own family, is racist.

I mean really. Taking the picture of living and beloved child and not even asking permission. The arrogance of these people.

Sue 'em to the Moon. Take all their donations away. Shut 'em down.

6. It was a stock photo they used

I remember reading about this before
http://www.dailymail.co.uk/news/article-1360635/Tricia-Fraser-demands-apology-anti-abortion-billboard-using-daughters-image.html

"Speaking to both Fox News and the New York Daily News she revealed that she had taken all her children to a modelling agency to be photographed two years ago and signed a release form to say the images could be sold for stock images."
*****

Honestly, if she let it go to stock use, I don't see how she can legitimately win a lawsuit. Unless there was a clause that said "no use in anti-abortion advertising" it was obtained legally and used legally.

edited to add: The NY Times story left off this one sentence:

"Though the photograph was obtained legally, the lawsuit claims its license prohibited the use of the image in "defamatory" ways."
