(UPDATED 10/29/10, 12:22pm PT: The North Carolina Republican Party has now filed suit against the State Board of Elections "alleging that touch-screen machines are thwarting efforts by voters to cast Republican ballots"…)

It would have been nice if these guys had spoken up years ago, when the bulk of the Republican Party and their sympathizers were labeling Democrats as "conspiracy theorists" and "sore losers" for their documented complaints of touch-screen voting systems flipping votes on screen to Republican candidates. But better late than never, we suppose.

On Thursday, Legal Counsel for the North Carolina Republican State Executive Committee sent a letter to the NC State Board of Elections threatening legal action if their "demands" were not "immediately" met for taking a number of specific actions to mitigate reported touch-screen voting problems describes as "significantly more widespread than the NC GOP initially understood."

The GOP attorney, John E. Branch III writes that the voting system problems should have been addressed prior to the early voting period "and, to the extend they were not, the touch screen systems should have been been banned"…

23. The most likely explanation is a few isolated, unrelated machine malfunctions
Never attribute a problem to software until you have ruled out the possibility of a hardware problem.

I would love for the Democrats to take every seat and it be a clear result of faulty voting machines. That would be a beautiful thing on many levels. But it is probably rigged for the Rethugs and this is a cover.

All I know is that I hope that the guys who have picked the winners this year in each machine are democrats.

I knew this was coming. As soon as they realized there was no "tidal wave" they started framing another way for their "victory" to come to light. I wonder if any of that "conspiracy theorists" and "sore losers" BS is still in the InterTubes. I feel a montage coming on.

I doubt you would. You'd probably check the formula.

In this case, without ruling out hardware trouble, they might start with the ballot definition file. Wouldn't be the first time that was the culprit.

The first two questions I ask are "Is it plugged in?" and "Is it turned on?".

Pretty much every problem with a voting machine that I've heard about sounds like it could be a failure of a touch screen or some other piece of hardware.

That would be quick and easy. If that checked out OK I'd want to run low-level tests on the input device, memory, etc.
