Court upholds D.C. same-sex marriage

The D.C. Court of Appeals has upheld the District same-sex marriage law, ruling in a 5-4 decision that opponents do not have the right to put the issue before voters, the Post's Tim Craig reports.

Vile bigots. They won't win in the District even if they won the court fight, which they won't win either unless SCOTUS decides to intervene.

Until courts are voting 9:0 in our favor, we cannot rest.
A 5:4 decision is really an outrage in itself.

6. It was 9-0 on the question of the discriminatory character of repealing same-sex marriage.
It was 5-4 on the more technical legal issue of whether the Human Rights Act can legitimately restrict the DC initiative power.

8. These right-wingers are certainly ultra-democrats when it comes to certain issues.
I don't think they want a plebiscite on many other things though. The left needs to navigate the initiative process better. There are some things that would be tremendously popular that could be brought to the voters. If nothing else, we could bleed the corporate donors dry.
