NY court gives government victory against ACORN

NEW YORK (AP) - A federal appeals court in New York has temporarily blocked a judge's ruling that found it was unconstitutional for Congress to halt federal funding of activist group ACORN.

The 2nd U.S. Circuit Court of Appeals in Manhattan issued its one-page order Wednesday, a day after the government lawyer argued that the stay of the ruling was necessary.

The government had argued that it was necessary to block the ruling by a Brooklyn judge to ensure that federal agencies were not required to commit funds that have not been appropriated by Congress. A lawyer for ACORN said it may appeal the decision to the Supreme Court because the cutoff of funds was crippling ACORN and jeopardizing housing for poor people. A lawyer for the government declined to comment.

1. ACORN needs to sue Breitbart et al. They've certainly demonstrated they've been damaged

3. They are suing Breitbart, O'Keefe and Giles.
If this ruling holds, then as Rep. Grayson points out, the Government will have to go after all Organizations, like Halliburton eg, who receive funding, because they cannot single out one corporation for 'punishment'. I don't know how this judge thinks that the original ruling wasn't correct.

I hope ACORN does take it all the way to the Supreme Court. Not that I have much confidence in this court, but at least it would get the story into the media and people, once they have the facts, would see how the rightwing goes after anyone who tries to help the poor in this country.

Shame on Congress for not speaking out and apologizing for that shameful vote.

5. Well... yes and no.
You are of course technically correct... but in this case it's very close to one because ACORN is hanging by a financial thread with a 99% reduction in staff. A few more months without funding could bury them.

So they could win and still end up losing.

6. Yes, it is all part of the smear campaign. There is no excuse for this ruling. It is just manuever.
AP put the word 'victory' in there on purpose.
