| Bill O'Reilly to Pay Court Costs of Fallen Marine's Father (who sued Westboro Baptist Church) |

Source: TVNewserNewsmax reports FNC's Bill O'Reilly will pay the legal fees for the father of a fallen U.S. Marine who sued members of the Westboro Baptist Church who picketed his son's funeral. The church garners attention for its views by protesting high-profile funerals. On March 3, 2006, Marine Lance Cpl. Matthew A. Snyder died in a non-combat related vehicle accident in Al Anbar province in Iraq. During the wake that was held after his son's funeral, family members turned on the television to view coverage of the massive procession involving over 1,500 persons. They saw the church members waving signs and protesting the funeral. Last night on his show, O'Reilly said the mounting legal fees, are "an outrage." The judgement was overturned by 4th Appeals Court. He is liable for WBC's legal fees. They are trying to get another $96,000 out of him. He was on Mitch Albom program today. If O'Reilly is paying the $16,000, the way I understand it, it would go to WBC.

Because the appeals court reversed the ruling of the trial court, Mr Snyder, as the losing party in the appeal, is obligated to pay the court costs.
No money, whether it's paid by Snyder, o'reilly, you, me, or anyone else will go to phelps and his gang of assholes.
Why the appeals court reversed the trial ruling, I don't know.
I heard Mr Snyder on the radio this morning saying his appeal has been accepted by the Supreme Court and he expects that it will be heard in spring of 2011. So I'm assuming that the payment of the court costs will be deferred until after the supreme court has ruled. Which means that O'Reilly will not actually be out of pocket the $16k any earlier than that. And maybe never if the supremes reverse the appellate court. So let's not be too hasty in giving any credit to this asshat. Believe me he has figured that out. And even if he does have to pay, the money will actually be paid by Fox and they will get their money back ten fold in free publicity for billo. They will be bragging this up for months.
If 1000 people each paid 16 bucks we could avoid all the smug self congratulation that is going to arise from this. I'll offer right now to pay ten share ($160) if someone wants to organize a fund.

If you bring a lawsuit and it is thrown out of court, you are responsible for paying the court fees of the person or entity you sued. That is just a way of discouraging frivolous law suits and I agree with it. The judge threw out the case because it had no merit. No has a right not to be offended, no matter how nasty, as long as the speech is not actually defamatory. There is rightfully a very high bar for defamatory speech. Free speech is more important than anyone's sensibilities. I am a free speech absolutist. While the Westboro Baptist Church says a lot of nasty things, they have every right to their speech, as distasteful as it may be, even if they picket funerals of soldiers. As long as they are on public property, there is absolutely nothing anyone can do about it, except to counter their protests with other protests, the way people do at KKK rallies.
