ST. PAUL, Minn. -- The Minnesota Supreme Court on Tuesday ordered that Democrat Al Franken be certified as the winner of the state's long-running Senate race.

The high court rejected a legal challenge from Republican Norm Coleman, whose options for regaining the Senate seat are dwindling.

Justices said Franken is entitled to the election certificate he needs to assume office. With Franken and the usual backing of two independents, Democrats will have a big enough majority to overcome Republican filibusters.

Coleman hasn't ruled out seeking federal court intervention.

Even if they said Franken won, that doesn't mean they will direct him to sign, although I can't imagine them not doing so, especially since Coleman has already said he's going to quit.

105. Pawlenty's been trying to stay out of this as long as possible.
I have a feeling that the SC ruling will be the final motivation required. It is unlikely that the SCOTUS will overturn a 5-0 state SC ruling without opening a serious can of worms, I don't even think they will hear the case.

Senator Franken is all of those things plus a math geek at Harvard who aced the SATs. Any one of those is enough to send the wingers spiraling , the combination almost guarantees their descent into the wingularity- a black hole of stupidity whose ever-increasing density prevents the escape of any coherent thought. I'm sure the wingers are looking at Senator Franken as a possible source of Biden-like gaffes on steroids, but given his demeanor during the campaign, the interminable inane challenges by no-clue Norman, and his considerable intelligence I look for him to employ a well-aimed and well-timed needle deflating the usual winger hot air balloons with grace and aplomb. They're going to be sorely disappointed.

It is U.S. Sen. Al Franken.

The Minnesota Supreme Court today decided that Franken, a Democrat, won the highest number of votes in last year's U.S. Senate race and deserves a signed election certificate.

The court said that Republican Norm Coleman didn't prove that a lower court made mistakes requiring a rehearing of the case. Coleman had asked the court to order thousands of rejected absentee ballots counted. He had hoped the counting would allow him to overcome Franken's 312-vote lead.

The court's decision brings to an end the seven-month state fight over the Minnesota Senate race. Franken has had a lead since January and a trial court decided in April that he won the highest number of legally cast votes.

But Coleman has fought that determination, first in front of a three-judge panel and then in front of the state Surpeme Court. He had left open the possibility that he would wage a federal court fight for the lead either by appealing to the U.S. Supreme Court or by encouraging supporters to file a suit in federal court.

Neither of those would necessarily keep Franken from being seated.

Norm Coleman should be ordered to pay Senator Franken the money he would have earned as a Senator out of Norm Coleman's own pocket.

Yes, he should refund Sen. Franken's legal expenses, but more importantly he should pay the senator for all the time he wasn't allowed to work.

The Minnesota Supreme Court on Tuesday ordered that Democrat Al Franken be certified as the winner of the state's long-running Senate race.

The high court rejected a legal challenge from Republican Norm Coleman, whose options for regaining the Senate seat are dwindling.

Justices said Franken is entitled to the election certificate he needs to assume office. With Franken and the usual backing of two independents, Democrats will have a big enough majority to overcome Republican filibusters.

Jim Manley, a spokesman for Senate Majority Leader Harry Reid, said the earliest Franken would be seated is next week because the Senate is out of session for the July 4th holiday.

I can find a link if you'd like--but it was in the Strib this morning, so I am fairly sure T Paw had a good idea that this was coming out today. Plus the MN mood for Norm is getting VERY sour, I think the Republicans sense it is time to stop digging the hole.

I too saw that one the other day. The WaPo link I cited is, I think, taking it's cue from your link where it quotes Pawlenty saying “I’m not going to defy an order of the Minnesota Supreme Court. ...", the indication apparently being that MnSC might actually have to order him to do it to obtain his compliance. But thank you for replying with your link. I think the two of them together sheds some light on whether this battle might finally be over or whether Coleman and his misfits might yet try to prolong it.

They didn't order him, so he might not sign. The court said Franken won, but that has been evident for a long long time. If the court didn't give a direct order, I think Timmy won't sign.

I bet he will wait to see if Coleman will appeal. Coleman recently received a million from the party.

Coleman will take this to Federal court, where he will one again use delay tactic after delay tactic. As soon as he files in the Federal courts, Pawlenty will think about his future presidential ambitions and realize that he can't get nominated without the GOP machine behind him, and fall in line and refuse to sign the certificate.

The Minnesota Supreme Court ruled today that Democrat Al Franken won the U.S. Senate election and said he was entitled to an election certificate that would lead to him being seated in the Senate.

"Affirmed," wrote the Supreme Court, unanimously rejecting Republican Norm Coleman's claims that inconsistent practices by local elections officials and wrong decisions by a lower court had denied him victory.

"Al Franken received the highest number of votes legally cast and is entitled to receive the certificate of election as United States Senator from the State of Minnesota," the court wrote.

In upholding a lower court ruling in April, the justices said Coleman had "not shown that the trial court's findings of fact are clearly erroneous or that the court committed an error of law or abused its discretion."

That is NOT what the court said. They said Franken was 'entitled' to the election certificate, but it did not go so far as to order it in their ruling.

If Coleman challenges, the next stop is the Supreme Court. With theoretical 60 votes at stake (not really since Kennedy and Byrd are not present), my odds are that Coleman challenges it, hoping to simply delay seating Franken until Oct/Nov when the Supreme Court is in session again.

The court has in effect issued a 10-day stay before the order/opinion takes effect in order to give Coleman an opportunity to evaluate legal options.

I wouldn't put it past Coleman and the Rs to drag this out for another year or two in the federal courts. Based on Pawlenty's statement this weekend it appears he is ready for this to be over. As well he should, he isn't running for another term but has national office aspirations.
