Source: NY TimesNew Hampshire legislators have approved a measure that would make the state the sixth to allow gay marriage. Gov. John Lynch is expected to sign the legislation Wednesday afternoon. He had promised a veto if the law didn't clearly spell out that churches and religious groups would not be forced to officiate at gay marriages or provide other services. One thing I've noticed is Graniteheads may be conservative; they're also egalitarian and that's not necessarily a contradiction. They tend to believe that fair is fair.
Since the Repubs went with their Southern strategy, they've treated New England like the red headed step child. It takes a lot and long time to piss off these folks, but once they are, they're implacable.
And Dr Dean energizing the NH Dems helped, too.

They mostly belong to what I call the "Leave-me-the-hell-alone" wing of conservatism. They don't necessarily want to mess with anyone else's business as long as they stay out of theirs. Kind of a more libertarian take on conservatism.

The two largest religious denominations in NH are Roman Catholics and Congregationalists/UCC, with a larger than average number of Orthodox in Manchester, Nashua, and Dover. Not a mixture that lends itself to the religious right mindset.

The cowards introduced in committee as a marriage bill, but then changed the language. So many Chicago Dems are Catholic (in the legislature) that they figured this was the best they could hope for. Did I mention that they're cowards?
I've called both my rep and my senator and said I'd prefer it be marriage, but that they should support this if it's the best we can get. For now.
Blue state my ass.

thank heaven, both sides opposed it. Result is, the Supreme Judicial Court decision still stands. In Massachusetts, though, a constitutional amendment reversing a court decision cannot get on the ballot unless the Legislature acts during its first or second session after the decision. The first session did nothing. By the second session, seemed like no one cared anymore.
I think gay organizations should fund a trip by some of your state legislators to Massachusetts. It's basically a non-issue for the opposition now. I rarely hear anyone mention it, even the folks who were up in arms after the court decision. It's lovely.

It is not clear how a civil union state (or country) will treat a marriage - my guess is it would be treated as a civil union by those states. I'm not aware of any court cases (or the specific statutes in those states).
Marriages will not be recognized by the federal government or by any state that has a marriage discrimination amendment or statute without a court fight (and please, don't bring a court fight just yet - the time is not ripe to force this particular issue, but it is moving rapidly in that direction). States whose statutes and constitutions are silent will probably have to wait for a court decision.

Churches would not have been forced to marry any couple that did not meet their criteria for marriage anyway (previously married in the church without an annulment or death of the former spouse spouse, lack of membership in the church, refusal to participate in pre-marital counseling, wrong color eyes, etc.). The provision just takes away the strawman that had thrown up recently (including by some folks who purportedly support same gender marriage but don't want to the state to interfere with religion).

By renting to all comers, they had turned religious property (inside of which they could discriminate) into a public accommodation (which is subject to anti-discrimination laws).
Because it wasn't a matter of intruding on the practice of faith, but an issue of whether once you open your facility up for public use you can violate anti-discrimination laws to limit that public use, it is unlikely anything in the New Hampshire law would force a different outcome in similar case in NH. I haven't read the New Hampshire law - but the New Jersey case was not as it is usually characterized.

The New Jersey case was a public accommodations case (not necessarily a business, but that is one example of a public accommodation). If you turn your religious property into a public accommodation, you cannot discriminate against protected classes with regard to that public accommodation. The court ruled the beach pavilion was a public accommodation because the church had previously rented it out to anyone who paid the fee to use it. Under Federal law, once it opened it up as a public accommodation it would be barred from rental discrimination based on federally protected classes - it could not refuse, for example, to rent it to a Jewish couple for their wedding ceremony because they were Jewish. That would constitute discrimination on the basis of religion. In contrast, they could legally refuse to permit that same Jewish couple to rent their sanctuary for their marriage (unless they had also turned the sanctuary into a public accommodation).
I don't recall the precise details of the NJ case - but since sexual orientation is not a protected class under federal law, the case was probably decided under an equivalent NJ law prohibiting discrimination based on sexual orientation - and if sexual orientation is a constitutionally protected class in NH, the outcome should be the same.
As noted above, I have not found any reference to business ventures or employment in the NH bill - but the issues are similar to the public accommodation issue. Discrimination is permitted for internal religious affairs, but not for employment that is not integral to the practice of the faith.

Fear of it happening is one of the things that has the anti-gay crowd so riled up, and it's not like most people seeking such a marriage would be likely to do it at a congregation that would be try to refuse them in the first place. It seems like a no-cost win-win sort of thing to me, where everyone involved gets their rights affirmed.

As a resident of California where prop 8 was recently passed, I am incredibly happy to see that some states are owning up to the statement that we were all created equal. However it seems a little bit ridiculous to have the caveats that they have stated. But I guess win some lose some. Yeah, next to roses, lilacs are my favorite flower. They're all over the place up here, even growing wild. They bloom around the last couple of weeks of May, so a wonderful way to start summer.
Our summers don't last long, but they're filled with flowers, daffodils, lilacs, roses, lupen, cone flowers, day lilies, wild asters. Makes the winters bearable.

The irony is that churches have been marrying homosexual couples for decades now. This is just the state finally legally recognizing what many churches have been doing for so long.
A church doesn't have to marry anyone. They can't be forced or required to marry anyone. It is entirely voluntary. Always has been. Always will be.
To put language in the bill to not force churches to do something they don't have to do anyway is pandering.

CA state legislature passed same-sex marriage bills TWICE -- it was an asshat Rethuglican gov, Schwarzie, who vetoed it TWICE. And because 6 of our 7 state supreme court justices are also Rethuglican, we lost the Prop 8 suit. Even the closeted lesbian justice, Carol Corrigan, voted to uphold Prop 8. Guess her identity as a fascist, oppressive Rethuglican is more important to her than her sexual orientation (and she's also dyed-in-the-wool Roman Catholic, so that explains everything.)

older state stores here were like drugstores, with a counter and clerks, and the State of NH default color is dark green, so: Been to town, Joe? Ayuh!Got groceries, went to the clnic, the hardware, and got a jug at Doc Green's for my cold!
And after last weekend's wedding, we have 2 Dr. Greene's in the family! Royalty, by NH standards.....

churches have always had the right to marry or not marry anyone they wanted.
but marriage isnt a religious institution anymore.
i can go get married with a witness at the courthouse without any religious ties.
therefor, marriage is a SOCIAL institution, and as such entitles everyone to be treated equal in acquiring it from the government.
and if they want to fight over the word 'marriage' then i say bring it.
lets see them try to take away the word from all the people who got married at a government building instead of at a church.

Hubster and I were married by a JP in our home. We have a piece of paper from the state of FL with the words Marriage Certificate on it.
He and I are married; we're not civil unioned. Further, unlike a lot of people who had a religious ceremony, we're still married.
And yes, same sex couples should have exactly the same. Anything else is blatant discrimination.

It's not just that New England tends to be a more liberal part of the country. It's also because the states are fairly small and very close together. Just about everyone in NH knows people in VT and ME. Everyone in MA knows people in NH and CT. And so on. They've seen that the sky hasn't fallen in the states next-door when they legalized same-sex marriage. That makes it a bit easier to accept, even for people who normally would oppose it. It's a bit different in larger, more spread out states. A person who has lived all their lives in these larger states may not know a lot of people in the places where marriage equality is already legal. So to them, it seem like a strange, scary idea.
I live in MA, and I can be in any one of 6 other states within a 2-hour drive. I live less than a half-hour from NH, and about an hour from the southern edge of ME. I know what's going on there, and the folks in those places know what's going on here.
I think a big round of applause is due to the folks in VT, who went out on a limb all those years ago when they legalized civil unions. No, it wasn't marriage. But they have marriage now, and I think the fact that they started granting legal unions to same-sex couples has a lot to do with why equal marriage is becoming legal in other places now.

Celebrate if you want. Having lived these 40 years just makes me angry. No furious!
How dare the religious bigots and weak politicians cheat me out of 40 years of my Rights.
If their god exists, may he damn them to Hell for the life they have cheated 15 percent of their relatives and countrymen out of.
