U.S. Decides to Release Detainee at Guantánamo

The Justice Department announced Monday that the administration had decided to release a detainee at the prison at Guantánamo Bay, a Yemeni doctor who the Bush administration once claimed had taken part in an anthrax program of Al Qaeda.

The government had backed away from the anthrax accusations but had continued to hold the detainee, Dr. Ayman Saeed Abdullah Batarfi, asserting that he had worked for a charity that had terrorist ties and that he had met with Osama bin Laden.

The decision to release Dr. Batarfi came in the third case the Obama administration has reviewed under new procedures the president put in place to analyze the cases of military detainees in preparation for closing the Guantánamo prison in Cuba.

Previously, a Guantánamo detainee, Binyam Mohamed, was released and returned to England. In the other case, a detainee who had been held by the military inside the United States for nearly six years, Ali Saleh Kahlah al-Marri, was transferred to be prosecuted in the civilian courts.

WASHINGTON (CNN) -- A Yemeni man held by the U.S. military since late 2001 is to be released from custody at the Guantanamo Bay military prison after the Obama administration asked a federal court Monday to postpone his pending case

Still, the release of Ayman Saeed Batarfi, a doctor, will not be an easy matter, officials said. The "hard part" will be finding a country willing to take him, one Justice Department official told CNN.

Batarfi, 38, is among the longest-serving suspected terrorists held in U.S. custody since the September 11, 2001, attacks, though his lawyers deny he is a terrorist.

Batarfi was first held at Bagram Air Base in Afghanistan and transferred to the Guantanamo prison in early 2002. His defense team contends he has been held there for years in virtual isolation, and forced to provide involuntary statements about his alleged terror activities.

Though the Bush administration declared him an enemy combatant, alleging ties to al Qaeda, he has not been formally charged by the military.

I can not believe this man has any love for America after eight years of confinement and torture without even being charged with anything.
