Texas Democrats' Loyalty Oath Legal, Court Says (Kucinich, Willie Nelson Attempt To Have Scrapped)

AUSTIN, Texas - A federal appeals court has rejected an effort by former presidential candidate Dennis Kucinich (koo-SIN’-ich) to scrap the Texas Democratic Party’s loyalty oath for candidates seeking the party’s nomination.

The party requires candidates to pledge to “fully support” its eventual nominee.

A three-judge panel of the 5th U.S. Circuit Court of Appeals in New Orleans on Tuesday affirmed a Texas federal court’s ruling that the oath does not violate the U.S. Constitution.

Kucinich claimed the rule violated his free-speech rights. The Ohio congressman filed the lawsuit with a prominent supporter, country singer Willie Nelson. Kucinich abandoned his second presidential campaign in January 2008.

1. A party primary is a private family decision, and they can make their own rules
A primary is not an election. It's a nomination process, and with few exceptions (the all white primary was ruled unconstitutional in 1944), the party can make their own rules as they see fit.

Guess he wants the Dem party to be less like the Repub party, imagine that.

I can as easily say, "it's Texas."

9. Legal or not, this is pretty lame.
I know a lot of people on DU are pretty big on supporting the party for better or for worse, but following one's conscience is a much better policy.
