(Nebraska) High court upholds firing of trooper in KKK case

LINCOLN – The Nebraska Supreme Court this morning upheld the firing of a Nebraska State trooper who joined a group tied to the Ku Klux Klan.

The state’s highest court ruled that Robert Henderson joined an organization "that is expressly opposed to Nebraska’s founding principles."

"From its very inception, the State of Nebraska has been founded upon principles of equality and tolerance that the Ku Klux Klan, from its very inception, has used violence and terror to oppose," said the 4-2 opinion written by Supreme Court Judge John Gerrard.

“We’re pleased with the court’s ruling," Nebraska Attorney General Jon Bruning said. "A man who embraces racism and white supremacy shouldn’t be allowed to carry a gun and a badge.”

1. Wow! I'm surprised. I thought since this is redneck Heaven that
they'd reverse the ruling, not uphold.

4. You would really be surprised. I live here. I should know. I work
with guys that I have to fight with all the time because of this election. One has a Reagan/bush** screensaver.

I know when he was here by the way. I am not comatose.

3. Not just a badge but also a gun.
Don't let the terrorists have arms -- whether in Nebraska or northern Mexico.

5. A threat to freedom of association is a threat to me, even when
a f**king pig joins the klan. Don't get me wrong - I'm all for firing (at) the mo'fo' - but I lost a little freedom there, too.

6. I live in Nebraska and as much as I despise the idea of
an officer of the law being racist I would not want to be fired because of the legal groups I belong to. If he behaved in a racist manner while on the job, then fire him, but not for this.

LINCOLN -- The Nebraska Supreme Court today upheld the firing of a Nebraska State Patrol trooper who joined a group tied to the Ku Klux Klan.

The state's highest court ruled 4-2 that reinstating Robert E. Henderson to the patrol would violate Nebraska's "explicit, well-defined, dominant public policy" of nondiscrimination.

"From its very inception, the State of Nebraska has been founded upon principles of equality and tolerance that the Ku Klux Klan, from its very inception, has used violence and terror to oppose," said the majority opinion, written by Supreme Court Judge John Gerrard.

But Judge Kenneth Stephan, in the dissenting opinion, said the court majority showed a willingness to ignore the state's violation of Henderson's First Amendment rights.
