Bush to Install Judge, Bypassing Senate

WASHINGTON (AP) - Bypassing Senate Democrats who have stalled his judicial nominations, President Bush will use a recess appointment to put Alabama Attorney General William Pryor on the 11th U.S. Circuit Court of Appeals at least temporarily, government sources said Friday.

The White House began informing senators Friday afternoon of Bush's intention, said one Senate source, speaking on condition of anonymity.

Two White House officials, also speaking on condition of anonmity, confirmed Bush's plan to install Pryor, and said a paper announcement was likely Friday afternoon.

The recess appointment, which would last only until the end of 2005, would be the second by Bush to sidestep Democrats who have mounted successful filibusters against Pryor and five other appeals court nominees.

3. Isn't there some kind of class action lawsuit here by the American
public vs. G.W. Bush regarding violation of our civil and constitutional rights???? There was a purposeful separation of powers between the Executive, Legislative, and Administrative branches of government.

I'm sure an intelligent attorney-type person could figure something out here. Maybe even subversion of the Constitution of the United States. Someone help me think of something.

7. What do you mean "Bush-style"
Yes there is a precedent for making recess judicial appointments. Clinton used a recess appointment to put Roger Gregory on the Fourth Circuit Court of Appeals. Recess appointments last for one year, after which the Senate will need to confirm.

However Bush has used recess appointments more than other Presidents have, and he's used them to nominate real wacko shits like Pryor and Pickering.

19. Its been done over and over and over
A well used and exploited loop hole.. including even by Prez Clinton... I believe hundreds of times in the past

They would need to close the loop hole.. or it will continue to be done..

25. Supposed to be emergency measure
This provision was put into the constitution to be used in an emergency, not as a means of bypassing the Senate.

Recess appointments last until the end of the NEXT session of Congress.

I don't think a new President can undo the appointment, but Pryor would not have much time left anyway.

Clinton also used recess appointments but Bush has used them more to circumvent the Dems in the Senate.

If the Dems lose ground in the Senate the stand off on judges could change.

Pryor because of the Judge Roy Moore case in Alabama. Now we know. Do you suppose the Administration was up to its eyeballs in the Judge Moore case.

Just remember wondering at the time how Pryor's oppossition to Moore would affect his own nomination. No - I don't know how it fits but there's something "there" and I can't figure it out.

Congress is in recess only for this week, because of the holiday. Next week, they're back in session.
