Bush to again use recess appointment - Bill Pryor on the 11th US Circuit
(02-20) 11:14 PST WASHINGTON (AP) --

Bypassing Senate Democrats who have stalled his judicial nominations, President Bush will use a recess appointment to put Alabama Attorney General Bill Pryor on the 11th U.S. Circuit Court of Appeals at least temporarily, government sources said Friday.

The White House began informing senators Friday afternoon of Bush's intention, said one Senate source, speaking on condition of anonymity.

is thumbing his nose at the Democrats and the public by doing this. I hope this gets worldwide play in the media and John Kerry and John Edwards lets him have it when they appear in public. I thought Pickering was bad, but this is beyond the pale. Pryor is worse, lots worse.

This is a crock of shit - they have approved 96% of his nominees - only the most unqualified or outrageous have been filibustered, yet the whore who wrote this article makes it sound like poor Bush has been thwarted at every turn.

13. just got this e-mail from Senator Jon Corzine on this issue
President Bush has yet again decided to endanger the civil rights of African-Americans, women, and the gay community with his recess appointment of Alabama Attorney General, William Pryor.


This is the second time THIS YEAR he side-stepped the authority given to the Senate, in the Constitution. First, in January with Charles Pickering – another extremely conservative and controversial appointee – and NOW THIS. Pryor has no judicial experience, yet does have a record of pushing his far right agenda well beyond cases affecting the state of Alabama. His basic philosophy can be described as anti-minority, anti-family, anti-women's rights, and anti-gay rights.


On minorities: In his testimony before a Congressional committee Pryor strongly opposed section five of the Voting Rights Act, which protects the voting rights of African-Americans.
On families: Pryor said "My job is to make sure the state of Alabama isn't run by a federal court. My job isn’t to come here and help children." Under Pryor, Alabama was the only state that challenged the constitutionality of the "Violence Against Women Act." Further, Pryor asserted that states cannot be sued for damages if they do not allow employees to take leave under the Family Medical Leave Act.
On women's reproductive rights: Pryor strongly opposes Roe v. Wade calling it, "The worst abomination of Constitutional Law in our history." Since the constitution does not specifically mention abortion, Pryor believes it should be illegal.
On gay rights: In an amicus brief Pryor made known his belief that legalizing intimate relationships between same sex couples would legalize consensual prostitution, adultery, necrophilia, bestiality, possession of child pornography, incest, and pedophilia.
Pryor is a strong friend to George W. Bush and his extreme right-wing pals. So strong in fact he was the only State Attorney General to file an amicus brief in support of Bush, in the Bush v. Gore case.


With your help, Democrats in the Senate stopped Atty. General Pryor’s nomination twice. The Senate Democrats fought tooth and nail to keep this man off the federal bench. Will nothing stop George W. Bush from forcing his own personal conservative agenda on America???


It is clear that we must have a Democratic Senate to stop Bush from turning back the clock on civil rights. Send a message to President Bush and the intolerant and radical Republican right wing that we are not going to stand by while they turn their backs on the civil liberties of all Americans. Let President Bush know we are not going to stand by while he defies the will of the Senate in an effort to deny millions of Americans the civil rights that Dr. King, Bobby Kennedy and countless Americans died for.


Send a message to President Bush that our federal courts do not belong to the intolerant, they do not belong to Halliburton and they do not belong to Tom DeLay, Karl Rove and the rest of the radical right wing Republican machine.


The courts belong to all Americans - and with a Democratic Senate in 2004, Democrats will give the courts back to all Americans.


Support the DSCC right now to elect more Senate Democrats. We only need two seats for a Democratic majority in the Senate. We must not allow the Bush Administration to railroad the Senate's constitutional role of Advise and Consent at the same time destroying our civil rights.

During the community's attempts to stop the confirmation of Jeffrey Sutton, we heard from many on the other side that Sutton was just a "hired gun." Well, now the man who hired Sutton to weaken the ADA in the Garrett case, Alabama Attorney General William Pryor, has also been nominated to a lifetime seat on the Federal Court -- just one step away from the Supreme Court....

William Pryor, nominated to the U.S. Court of Appeals for the Eleventh Circuit, has been a leader in the effort to limit congressional power to enact laws protecting civil rights. Pryor has prevailed in a series of 5-4 cases before the Supreme Court that have curtailed civil rights, including the Board of Trustees of Alabama v. Garrett, which successfully challenged the constitutionality of applying the Americans with Disabilities Act of 1990 to states as employers.

Pryor argued that the protections of the ADA were "not needed" to remedy discrimination by states against people with disabilities. This decision prevents persons with disabilities from collecting monetary damages from state employers. Most significantly, it has resulted in fewer attorneys being willing to represent individuals in ADA cases against state employers. Despite the massive record of egregious conduct toward individuals with disabilities by states that Congress had compiled -- including instances of forced sterilization of individuals with disabilities, unnecessary institutionalization, denial of education, and systemic prejudices and stereotyping perpetrated by state actors -- Pryor argued that states were actually in the forefront of efforts to protect the rights of individuals with disabilities.

Pryor has led the battle to undo the work of a democratically-elected Congress to legislate federal protections for American citizens. Despite widespread bipartisan support for the Americans with Disabilities Act (ADA), Pryor said he was "proud" of his role in "protecting the hard-earned dollars of Alabama taxpayers when Congress imposes illegal mandates on our state."


No wonder this meatball couldn't get through the Senate. Never mind, though: remember, Bush* has stated more than once, only half-jokingly, that "his job would be a lot easier if her were a dictator." Ahhh, dare to dream... </sarcasm>

Outright Attempt to Reverse Roe v. Wade Progresses

The fact that Norma McCorvey, better known as Roe, has changed her tune to become an outspoken opponent of a woman’s right to choose is old news. What’s new, however, is that 31 years after Roe v. Wade she has finally succeeded in getting her day in court - well, another day in court. The U.S. Fifth Circuit Court of Appeals has decided to hear oral arguments in McCorvey’s attempt to re-open Roe v. Wade. She wants to open the case in an effort to overturn the Supreme Court decision. The court date is set for early March.

This is shocking when you consider the factors surrounding this appeal. The Texas Justice Foundation, which filed the initial lawsuit on McCorvey’s behalf, is an anti-choice group whose main function is to provide legal services to the anti-choice community. The federal judge in Dallas that first heard their suit rightfully rejected it, perhaps seeing it as the political maneuver and media ploy that it is. Incidentally – the Dallas judge was appointed by George W. Bush and does not appear to be a choice supporter – simply a judge who was able to see past the political rhetoric in this case. But the plot thickens – as the 5th Circuit Court of Appeals, which generally hears oral arguments in less than ten percent of the cases filed, has agreed to hear arguments in this strange attempt to re-open a well-settled. With ultra-conservative judges like Charles Pickering sitting on the Fifth Circuit Court of Appeals, this case could progress and ultimately finds its way to the U.S. Supreme Court, again.

It’s a pretty scary thought and a solid reminder of the importance of the ongoing judicial nominations battle.
