Democratic vice-presidential nominee Joe Biden said earlier this week that he and running mate Barack Obama could pursue criminal charges against the Bush administration if they are elected in November.

As best I understand it, the president cannot pardon someone who has not yet been charged. Given the complete disregard for the law this administration has demonstrated, will anyone be shocked if Bush issues a "pre-emptive" phone book sized pardon list on 19 January? It will probably even include himself and Darth!
