Rodriguez Says No Immunity, No Testimony

With a full-blown criminal investigation in the works, Jose Rodriguez, the CIA official who ordered the destruction of the torture tapes, says, via his lawyer Bob Bennett, that he's not testifying about it to Congress without immunity. He'd been scheduled to speak to the House intelligence committee next week as part of their investigation.

If the committee did give him immunity, it could potentially compromise the criminal investigation. If they didn't, he'd probably spend most of his time pleading the Fifth. Bennett first signaled this course last month, when he warned that Rodriguez wouldn't cooperate with a "witch hunt."

If they don't he will plead 5th

9. You can't lock someone up for exercising their 5th amendment rights.
He has a right to plead the 5th, just like anybody else. I don't think that he'll "forget" either. Immunity only holds if the witness tells the truth. My bet is, there are those in Congress who know the truth. All they need is for the witness to put in on the record.

Promise him immunity AFTER he, in a private deposition, demonstrates that he has committed crimes for which he needs immunity. If he doesn't agree to that, then CHARGE HIS ASS with the crime of torture and destroying evidence of a crime (accessory after the fact), and put him on trial.

He'll talk.

6. Another demand for immunity
Golly, what conclusion, if any, should we draw from that? I mean, this not being a crminal trial or anything, but merely a congressional investigation. What is Mr. Rodriguez worried about? Well, I'm sure the Bushbots will be enlightening us through letters to the editor and their echo chamber mouthpieces, oooh, just any time now. We know for a fact that we can rule out any criminal culpability, because this is the most honest, open and law-abiding administration evah.
