The court denied a petition to reconsider its Dec. 15 ruling, which reversed a lower court's 2003 judgment against Philip Morris, the first "lights" case to make it to trial. Plaintiffs had alleged Philip Morris fraudulently promoted its Marlboro Lights and Cambridge Lights cigarette brands as being safer than regular brands.

The lawsuit is the first of at least nine statewide consumer-fraud lawsuits against major tobacco companies to wend its way through the appellate court system and is one of the legal hurdles New York-based Altria has said it needs to clear before it can spin off Kraft Foods Inc.
