Federal Appeals Court Upholds Ruling That 2003 Ban on Late-Term Abortion Is Unconstitutional
By DAN GOODIN Associated Press Writer
The Associated Press

SAN FRANCISCO Jan 31, 2006 — A federal appeals court declared the Partial Birth Abortion Ban Act unconstitutional Tuesday, saying the measure is vague and lacks an exception for cases in which a woman's health is at stake.

The three-judge panel of the 9th U.S. Circuit Court of Appeals became the second federal appeals court in the country to hold the law to be unconstitutional.

President Bush signed the abortion ban in 2003, but it was not enforced because of legal challenges in several states.

Looks like Scalito arrived just in time to stop those activist judges in the lower courts.

4. The Republicans wrote it in an unconstitutional way on purpose.
They could have actually made it legal

If they actually wanted a constitutional law, they could have written it to have an exception for the health of the Mother and it would have had huge bipartisan support.

They didn't actually want the law, just the talking point - unless they get a completely different Supreme Court which will revisit the entire issue.

6. That's why Clinton wouldn't
go along with them, because there was no exception for the health of the mother. They wanted to campaign on how evil he and the democrats were.

7. I know and I think almost everyone would have signed onto it if they
had included that language.

They knew it would be challenged and never actually be in effect.

9. Right to Lifers don't think there IS
any medical reason for abortion. As I wrote to one Freeper, did you ever hear of a full term baby being delivered from a fallopian tube? Do you know what happens to the woman when that tube ruptures? HER LIFE IS IN DANGER from HEMORRHAGING.

They are IGNORANT and MEAN SPIRITED people. Anyone who would force a 13 year old CHILD to bear a RAPIST's BABY is beyond CONTEMPT. Until we start dealing with them in the manner they deserve, we are doomed to fail.
