Bush administration wins victory over No Child Left Behind


WASHINGTON A lawsuit over President Bush's education program has been left behind.

A district court judge has thrown out a lawsuit that sought to block the No Child Left Behind law. The decision is a boost for President Bush's signature education policy.

The lawsuit had been filed by the National Education Association and school districts in three states. They'd argued that schools shouldn't have to comply with the law's requirements if the federal government isn't paying for them.

The judge said, "Congress has appropriated significant funding" and can require states to set educational standards in exchange for federal money.

Umm.. if the state isn't receiving fed money, it shouldn't have to comply.

Here's where the judge's statement doesn't make any sense because the plaintiffs argued that precisely, and the judge said, "Congress has appropriated significant funding" and can require states to set educational standards in exchange for federal money.

Well, if they're not taking fed money, then how can the fed require anything from them?

Anyone?

Then the judge is saying they do need to comply with the standards imposed by the Feds.

From my understanding, the states were contending that the tens of millions of education dollars they already receive are not enough to cover the implementation costs of the newly imposed standards. The judge basically said, "to bad, if you take the money they have a right to impose certain standards"...

Here's a table that shows the breakdown of local, state and federal funding for the 2001-2002 school year. Each state that was a party to this suit appears to be a recipient of federal education money.

to see what grade level he reads at.

Maybe that's the reason he doesn't read newspapers, and relies on his college dropout Karl Rove, for his information.

Quite questionable, in my humble opinion. What money, any money, all of the money they give the states for education, or just the NCLB money? That isn't anywhere near an adequate amount to fund a "mandate" such as that.

Things just get more interesting. :evilgrin:
