ET Federal prosecutors on Tuesday began proceedings to dismiss an indictment against Enron Corp.'s former accounting firm, Arthur Andersen LLP, by asking a judge to return the case to a lower court.
In the filing, the U.S. Attorney's Office is asking the 5th U.S. Circuit Court of Appeals to return the case to a U.S. District Court in Houston so that the judge can vacate the conviction against Arthur Andersen. Then the government can move to dismiss the indictment.
Rusty Hardin, Andersen's attorney, said he was elated by what he called a "very welcome event." "I think the current administration at the Justice Department ought to be congratulated for having the courage to do the right thing," Hardin said. "It brings to a close a very tragic chapter that I hope is not revisited on any other companies in the future."
This story actually broke during the Lou Dobbs show. I expected to come back, after the movie I was starting to watch, to read the uproar and... nothing. This one is being done on the QT. The way Dobbs explained it is that the government felt sorry for AA, because they had already lost so much :cry:, and are dropping the case. I kid you not. I for one am pissed. Does the government stop prosecuting the average Joe after they confiscate his/her property?! A government of the rich for the rich. The rest of us can go Cheney ourselves.
