ORLANDO, Fla. -- A Florida judge has ruled in favor of a Christian theme park seeking an exemption from property taxes.

The Holy Land Experience in Orlando is operated by a nonprofit, nondenominational Christian ministry called Zion's Hope, which is devoted to converting Jews to Christianity.

It had been granted only limited exemptions for administrative and education facilities.

The Orange County Property Appraiser's office had denied the group's broader request in 2001, arguing the park was a tourist attraction rather than a church.

But Judge Cynthia MacKinnon said all of the park is tax-exempt. In her ruling, the judge said Zion's Hope is using The Holy Land Experience "to spread what it considers to be God's word."

Donegan said Zion's Hope has paid only minimal taxes on the land and would owe $786,000 through February 2004 if they were forced to pay. Annual taxes would amount to about $215,000, he said.

Zion's Hope, which is devoted to converting Jews to Christianity, opened the park in February 2001. It offers recreations of scenes from ancient Jerusalem and biblical settings complete with costumed characters.

A gift shop sells books and religious-oriented gifts, and the Oasis Cafe sells food, all exempt from the state's 6 percent sales tax.

If the place is a bona fide non-profit. This goes way beyond property taxes. If it is determined that the place is non-taxable then people should be able to deduct whatever is beyond the value of what they receive. Outrageous!

This place is near my home. I drive by it almost every day. It is a prime piece of expensive Orlando area real estate. I have never been. It is promoted as entertainment. Fun for the whole family. I don't see how. Some contributers to this thread have some excellent ideas for making it fun. I see a rock climbing wall from the road where I wait for the light to change. Don't know about the rest. Heard they had some of the dead sea scrolls on display once or something like that.

This is a discussion that has been going on since the place opened. I really thought it was settled. The determination was that the property where the church is located was tax-exempt but that this was clearly a commercial enterprise. What they did with their profits and their underlying agenda did not change the function of the theme park.

I am shocked that a judge would rule differently. Sometimes I just hate living in this state! It's nice in January though.

We loved how we could drop the kids off at Isaac and Abe's Day-Care, so that we could dance the night away at Herod's Lounge. what happens at Herod's lounge stays there, folks - but you know what they say "When in Jerusalem. . . "

All in all, it was a vacation to remember. We had a great time, and never had we felt such an annointing and a calling from the Hornet-God Mochtilpochtli.

I pay to go to religious services all the time. My dues are $2500/yr, and if I didn't pay them, I would not be able to enter my shul on the high holy days. The IRS consider's my dues the same as money put in the offering plate.

Note the above is the case for most Jewish congregations in the US. There are always lower dues for the young (students) and poor, but there have been many fights about dues as well. There are usually high holy days that don't require entrance ticket's in a given area -- often put on by the Chabad in a hotel conference room or the like. But in many places, no ticket (which you either have to purchase or get as a member benefit), no services.

There's a huge difference here. I don't know if your dues are considered your tithe ($2500 would be considered a reasonable tithe in a protestant church for someone making $25,000/yr).

Admission tickets to get into a theme park are quite different from tithing your local religious center, church, temple, etc. Your church probably uses your tithe (or payment) to maintain the temple/church and to pay staff--and possibly to help out poor members. This theme park will use the money to convert Jews; I doubt it will be reinvested in the local community.

I just fail to see the parallel between tithing and buying tickets to an amusement park.

That being said, my point was more that "charging an entrance fee" by itself doesn't mean that its not a religious activity/location.

As for me, yes I can deduct the $2500 on my tax return like a protestant. One significant difference is that my membership is not set by my income -- its per person/family. That money by itself is used for the synagouge and purposes of helping the local Jewish community. I'm expected to tithe an additional 10% of my income to charitable causes of any sort, which don't have to be connected to my synagogue.

I really don't think the attitude here is that property taxes don't need to be paid because of the tourist revenue. That rationale translates to the lack of income tax for individuals.

While Disney does find its tax loopholes. It pays and collects lots too between property and sales and tourist tax. This place will be paying none. So there is no support for the stresses on the community caused by its guests and employees. No money for the schools its employees need, no money for infrastructure. They just take the money and run.

I don't know of any Jewish person who has gone there. But then I only know about 6 people who have been there - staunch Christian fundamentalist types. I will definitely be writing letters on this one.

Orange County is directly losing 1/2% sales tax - I think designated for school development, rehab. I don't know how much other we get from sales tax. I guess that's the source for much of the state money.

I think this is only right because the park here in Orlando is struggling. Why? No religious base? Wrong, the Christian rock station is very popular among families here. Nope, it's because it was placed next to the it-came-after-the-park-was-built Mall at Millenia. Ritzy types head to the very expensive Millenia while Holy Land is left to struggle.

Other businesses in Orange County are struggling. If they are unable to meet their expenses, including taxes, they are not viable and close. They are not given special dispensation because of inability to pay. I do not see in the article nor have I heard in other reports that the Holy Land's inability to pay was a consideration in this ruling. It is based on their stated religious function - which is really a commercial one.

The Mall of Milenia has nothing to do with the lack of success of the Holy Land. Ostensibly, it should help it because it brings lots of traffic past the park. People just aren't interested in going there. I don't think people are choosing between The Holy Land and Macy's. Between Bloomingdales or Macy's or Nieman Marcus is more likely their consideration.

Although the mall may have opened after the Holy Land it was planned for years. I suspect The Holy Land even factored this into the decision to build in it's location. Aren't the heathens shopping in the Ritzy Mall a great target market for conversion?
