TAMPA, Fla. - Warning that Terri Schiavo was "fading quickly" and might die at any moment, her parents begged a federal appeals court Tuesday to order the severely brain-damaged woman's feeding tube reinserted.



The appeals court didn't indicate when it might rule, but George Felos, the attorney for Terri's husband, Michael Schiavo, told the Associated Press that he expected a decision before daybreak Wednesday.......

.....The Justice Department (news - web sites) also filed a court statement, saying an injunction was "plainly warranted" to carry out the wishes of Congress to provide federal court jurisdiction over the case.

To be surprised or astonished.

The British comedian Frankie Howerd used to say in mock astonishment: “I’m flabbergasted—never has my flabber been so gasted!”. That’s about as good an explanation for the origin of this word as you’re likely to get. It turns up first in print in 1772, in an article on new words in the Annual Register. The writer couples two fashionable terms: “Now we are flabbergasted and bored from morning to night”. (Bored—being wearied by something tedious—had appeared only a few years earlier.) Presumably some unsung genius had put together flabber and aghast to make one word.

The source of the first part is obscure. It might be linked to flabby, suggesting that somebody is so astonished that they shake like a jelly. It can’t be connected with flapper, in the sense of a person who fusses or panics, as some have suggested, as that sense only emerged at the end of the nineteenth century. But flabbergasted could have been an existing dialect word, as one early nineteenth-century writer claimed to have found it in Suffolk dialect and another—in the form flabrigast— in Perthshire. Further than this, nobody can go with any certainty.

And Scotus doesn't favor this. And the Courts feel threatened. its everyman for himself and the courts will vote their own butts!

If the appeals court fails to overturn the ruling, I would bet that the case goes to the supreme court. And we all know what kind of relationship chimpo has with SCOTUS. or is that Scrotum, Supreme court ruling of the unmoral majority.

16. A mixed blessing.
I wonder if she will become a martyr for the radical right wing. We have already seen the extreme pandering by the GOP in congress and the chimperer to the fundie base. When she dies, and they scream for new legislation in defense of people in vegetative states, will they act?

Imagine having a loved one fall ill from an MI or CVA and lying in a coma with little chance for recovery. No living will, by federal law, the patient gets a tracheostomy and a feeding tube and goes to a care facility. You lose your right to make medical decisions, the decision given to the state at the behest of religious fundamentalists.

Sound unrealistic. I sure hope so. But, rule of law seems to be an alien topic to this administration, and the supreme court ruling in 2000 does not add much comfort.

is it correct to think that if the appeals court upholds the lower court's decision, the Schindlers will most likely appeal it at the Supreme Court? So there will be more waiting? Haven't the Supremes already knocked this back down to State Court already? Anyone know?

So as not to cause a ruckus in front of the hospice or the court building?? If they plan on saying put the tube back in and then she has to go back to the hospital, they may not want eighty cameras following the ambulance <along, no doubt w/ news helicopters along for the ride>.

. . . by malnutrition and dehydration. I am not a medical doctor, and I have no idea whether or not this is possible.

It would just be weird if she ended up worse off that she was before the food and water were removed, like in a coma.

34. This is only a three judge panel
If it denies the Schindlers' request to reinsert the tube, the Schindlers will certainly try to appeal further as quickly as they can. If it grants the Schindlers' request, the tube will be reinserted, and Michael Schiavo will appeal to the full, or "en banc" court and then try the Supreme Court. Either way, this will probably go as far as the courts allow the appeals to continue, on and on, unless and until God and Mrs. Schiavo take matters into their own hands. Wonder how much money has been spent on lawyers and court costs, etc. by all parties and all interests since this thing began. I'll bet we could have provided some very sick people with some very good health care for that money. What a pity.

Whatever the result you would think they would have gotten a better attorney for the money they must have in donations, to argue that she will go to purgatory in court is almost laughable and he looks creepy. The way they went after the Judge personally is not going to look good at all.
