Any prosecutor around--Bush appointee, Clinton appointee, Obama appointee--could get a conviction on KSM. It'll be like the trial scene in Idiocracy, where the "chief J" will rip off his robe, point at KSM, and yell "Whatever, man. The guy's guilty as shit. We all know that."
But the Fox "News" legal correspondent is right: these guys really want their one night of rehabilitation, so it's better if we just sentence them to life and be done with it. The best thing would be to build a smallish prison, one with maybe 100 beds, and throw all the convicted terrorists in it. As long as they have no contact with the outside world, they can't hurt anything--and there won't be non-terrorists in there with them waiting to shank them for destroying the WTC.
